Not positive, but I think the punishment is a lot less harsh if its <2 years. It's probably the difference between a misdemeanor and a felony, or something like that.

I believe it depends on the state law and varies from state to state. Sometimes it also depends if the younger persons parents press charges.
I'm not sure that rule applies to pictures, just the actual act.
The zero tolerance of many states has gotten a bit out of hand. I was reading on CNN the other day that some wal-mart in Arizona refused to develop photos of some 2 & 3 year olds first bath or something like that on the family's role of film. Needless to say the family wasn't happy about it.
You make a good point with the picture versus act comment. That seems kind of weird to me that you can do something, but aren't allowed to record it. Bet that's a real bummer for some people
A misdemeanor sex charge conviction still lands you on the sex offender registry. Sure, the jail time is less harsh than a felony, but being on the registry is an awful punishment in itself. A misdemeanor conviction requires a minimum of 10 years on the registry in Iowa. It's even more harsh in other states. Nebraska is one of the worst.
if two 17 year olds are sexually active with each other are they both "child molesters"? or is it only from the day of your 18th that you are "old" enough to know better than to be sexually active with someone who may be as little as 1 day removed from being a minor?

Reading the article, I didn't get the impression that the second guy is a football player.
However, if half of the UConn football team is in jail by next September for underage gay porn, then I have to like our odds...

Yeah, I don't think the other guy is a football player. He is, however, the president of the French Club.
As for the actual charges, looks like it actually was child pornography, and not just some pictures of his 17 year old girlfriend or something. Although, it's kind of hard to tell why he did it. He admits he had it, and he was supposed to send it to somebody. So, was he doing it out of his own personal pleasure, or was it for money, or what?
Age of concent varies from state to state, but for the most part it is 17, however if you take a picture, you are ****ed.
And that goes for taking pictures of your naked self too- imagine if the police busted the picture taker as well as the picture holder- try explaining that to you dad if you are busted sending a naughty picture to your boyfriend. I have a daughter now and I dont know what sort of rage I would have, but I do know that it would be a fault in my own parenting too.
