I can't imagine, but if I had a method to kill the person who just killed my daughter and stepson, I would probably utilize it.

I would think temporary insanity would have to apply here, wouldn't it?

The "right" answer is that he was in the wrong, he should have let the legal system take care of it.

...But. If I had watched some drunk jerk (who was underage, to boot) kill my children in front of me? I don't know that I would have done anything different. Drunk driving sickens me more than almost anything else, you're putting everyone else's families in your hands every time you do it.

Has anyone seen "Gone Baby Gone"? SPOILER: There's a scene where Casey Affleck kills a child molester, and I think he did the right thing.

Hard to fault him, especially in the moment. You see your two boys get killed or severely injured and no doubt rage is going to come. Is what he did justified? I dont see a problem with it, but yes there is a law.

But I for one think that happening over the man rotting in jail for 40 years wasting tax dollars is a better outcome.

He shot him at the scene of the accident? Yeah I don't think you can do that. Probably felt good at the time, but murder is murder.

I can empathize, but he obviously belongs in jail.

I think I would have him live with the guilt. Drunk drivers who end up killing folks tend to live with tremendous guilt, some even commit suicide over it. I would have a heavy dose of hate in my heart Im sure but wouldnt kill him. If he would have raped and/or murdered my children then yes. He would be suffering a slow death at my hand. If that makes sense. I know drunk driving is basically murder, but its not premeditated or malicious. It was a stupid choice, a stupid stupid selfish choice.

I agree with everything you said here Angie except for what I bolded. To me, when I see some 85 year old behind the wheel driving 40 miles an hour in the left lane on the interstate, drunk driving laws seem silly to me. What I am getting at is, if you are saying .08 is impaired for me, then you'd better start setting the bar allot higher for obtaining a license in the first place.

To me, it depends on how obvious it was at the scene that driver in fact drunk and not suffering from some medical condition.

True, but you're making an assumption that he was drunk enough to be visibly impaired. .08 BAC is also considered "drunk driving" and you would not be able to tell just by looking at a person.

If a police officer can shoot at,with intent to kill, someone who hits their squad car, why cannot this father shoot and kill the drunk driver who hit and killed his child?

It's happened in the last 2 weeks around DSM, Police officer shot at a car that rammed a squad car.
