FWIW, Parizek was on 1460 this AM and he thought it would be a tough case against the MMA guy.

I guess I don't see how it would be a tough case. While the video is limited, I can't imagine that leaving the situation wasn't an option for the MMA guy. And from what the video shows, the contact with him was pretty light (maybe there was more before, who knows). So based solely on the video, I'm not sure you can say MMA guy had legal justification to beat the guy up the way he did.

Here the response of the attorney representing the MMA guy from the GoFundMe page:

"My client would first like to state how much he appreciates the overwhelming support he has received from friends, family, and complete strangers as he deals with the aftermath of the events of February 13, 2021. As always, there is more to the story than what is depicted in the video. What is not shown is the original assault and battery suffered by Mr. Walker at the hands of Mr. Jones and his friend shortly before the captured footage. As can be seen, my client's nose and clothing were bloodied prior to the beginning of the video. Mr. Walker was legally justified in defending himself in this matter. As a result, Mr. Walker received several injuries including a torn bicep which will require surgery. We will not make any further comment until the conclusion of the investigation by the authorities."

It appears there was more happening from before this video started.

And there may well be. I guess to me it comes down to whether he had an ability to retreat and was his force justified given the risk.

I'm not going to shed any tears about a ****talker getting beat up. But I guess I also don't subscribe to the theory that just because you get hit it gives you license to beat the ever living hell out of someone if you're able to simply leave.

Yeah but Jones and his buddy could've left the scene too instead of being in the guy's face. Why is it automatically on the MMA brothers to leave the scene? Jones' side is the one saying "what you got?" and doing the initial shoving. And that's not including whatever happened before the video started that resulted in MMA guy's bloody nose. Jones was in his face, the guy has a right to defend himself.

Not to the extent he did. To me it comes down to when the injuries occurred. It was clearly escalated from a very minor injury to a very major injury, and it doesn't appear that injury is necessary.

All I'm saying is that if I am a lawyer picking sides on this one, give me the OU kids side.

We'll just disagree. If I'm his lawyer I can point to an obvious assault prior to the video evidenced by the bloody nose, the plaintiff bullying and challenging him, and then my guy being physically shoved, resulting in him defending himself. Seems like a pretty clear case of the plaintiff going out of his way to pick a fight. It's not the other guy's fault he's a better fighter. I think MMA guy actually could've done a lot more damage, basically punched him a few times, took him down, and restrained him via rear naked choke.

This is a bit of a passion project for me because I've seen many juveniles I used to represent get in trouble because they were misinformed about what constitutes self defense. I can't tell you how many kids would get an assault charge and think they were defending themselves, only for the facts to flush out that there was minimal threat and the responding force was entirely unnecessary.

The MMA kid may have a defense, I don't know. But when you had a bloody nose prior to the event, and the other kid walks away with a 4 hour eye surgery, you better have a pretty strong evidence that you had no other alternative and you only used the force necessary to defend yourself and remove yourself from the situation. I just don't see it.

It's just silly machoism that leads people to think that any threat to self gives you carte blanche to beat someone to a pulp. If you can't retreat you are allowed to respond with the force necessary to defend yourself. To me, the video shows it goes far beyond that.

All I know is if a teammate started **** like that, then got his ass kicked like that and then lawyered up we would have never stopped making fun of him.

I'd be willing to bet there are guys on his team who don't like him and would've been laughing whether he lawyered up or not. He comes off like a pr*ck.

The buddy with the turtleneck doesn't do much for this guy's image. Having a buddy that would go to a bar in that attire says alot about your character.

Who's talking 1800s? If a guy gets into another guy's face saying "what you got?", sorry that's a challenge and he should expect a response. I don't think he was asking about baking recipes.
