Man Calls 911 In Burger Beef - February 9, 2009

Thank god they charged him with misuse of 911 communications.

FEBRUARY 9--"You cannot dial 911 'cause you're unhappy with your burger." That's what a police operator told a Florida man early Saturday morning when he called 911 to complain about his order at a Burger King in Boynton Beach. As can be heard on the below police recording, Jean Fortune, 66, called 911 when a Burger King employee told him that they did not have lemonade. Fortune told cops that he had placed an order for a #7 combo meal (chicken fries, French fries, and a soda for $4.49) while in the drive-thru line. But when he got to the window, Fortune was told the fast food outlet did not have lemonade. He was offered Coke, but Fortune decided instead to call police. "Sir, come on. I know you don't seriously think that the police need to make Burger King give you food faster. I cannot believe that," said an exasperated 911 operator. She also noted, "Customer service is not a reason to call 911. 911 is if you're dying. Do you understand that?" Fortune was charged with abuse of 911 communications, according the below Boynton Beach Police Department report. Pictured above is the Burger King at which Fortune did not find lemonade.

Calling 911 is only warranted if they have light lemonade instead of regular lemonade. Talk about an emergency...

Did you listen to the call (from the link in the story). Good God!

It was hard to tell because the audio quality was pretty poor, but did he sound French to you? Maybe that explains it...:wideeyed:

I agree that this guy is pathetic, but the lady from the McDonald's case isn't as bad as people make her out to be. The coffee she was served was at 180 degrees, a temperture which is unsafe for human consumption, and would quickly cause the type of burns for which skin grafting is necessary. In fact, she received third degree burns to her vaginal area, perineum, and anus. McDonalds had received over 700 complaints regarding customer burns over the past ten years, but evidently concluded that the coffee sales generated by the higher temperature (thus more aroma) more than justified the cost of settling any potential lawsuits. The plaintiff offered to settle for a medical fees--$20,000--and an agreement to turn the coffee temperature down (and later for $30,000, $200,000, $300,000--including her legal fees for fighting a big corporate plaintiff), but McDonalds refused. When the case went to the jury, the jury awarded her costs ($200,000) plus an amount equal to two days off coffee sales for McDonalds: $2,7 million.

I'm not suggesting that many cases are frivilous and a waste of money, I'm just suggesting that the "McDonalds" "Stella" case isn't one of them. I always feel the need to share the underlying facts.

And yes my first post was both off point and in defense of the McDonalds coffee lady.

It was still ridiculous and a waste of taxpayer money to put into trial.
