Alright wife got a seatbelt ticket last week...cop wrote court time down as 01:30 on 11/19. Good enough to get it thrown out?

My mom got out of a speeding ticket in a work zone by one of those Camera's becuase she was not given a speedy trial. I think her court date was over like 60 days since getting the ticket.

Bring a pair of gloves that are too small and hit them with the "If it doesn't fit you must acquit."

If so how? I just got one and I dont want it to go on my record and make my insurance rates go up.

I actually fought one 15 years ago I didnt think i had any shot of losing since the guy that owned a house right next to where the cop was radaring from saw the entire thing and agreed to come as witness the cop was full of crap. Basically he gave me a speeding ticket cause I had a sports car and picked me out of line. I was actually sandwiched inbetween cars in left lane and he pulled me over. The cop had like 10 people fighting his tickets that day so that should have gave the judge a clue but I still lost. Afterwards the cop and I guy into outside the court house cause I called him a ******* Liar.

I don't know why being in the middle of a line of cars would have to do with anything.

Were you speeding? You were?

Then pay the fine. "I don't want my insurance rates to go up" is not a legal defense for speeding.

Apparently my sister in law back in HS was clocked doing 90 in a 55. This was about the same time that Branstad's kid got off the hook with just a misdemeanor for killing 2 people in a car accident for wreckless driving. Her dad argued that if the governor's kid can basically get off the hook for murder with a car she should get get some slack and be let off with a warning for speeding. Somehow the judge bought it and cleared the ticket!

Ironically I met Eric Branstad right after college at a bar because one of my friends worked at the state capitol where he had some job too and I can tell you that kid is an idiot and supposedly was a pot head as well which isn't too surprising to believe once you've met him.

Way to be accountable for your actions. Such a lost cause in today's world.

Thank you! Would you just copy this and paste it in the, "help me find a lawyer, I just got a public intox and don't want to lose my new job" thread too. Then keep it handy, unfortunately I'm sure we'll need it again.

No, but I've never gotten a speeding ticket in my life. Ever. And I'm in my 40s.

You need to live a little. And as far as your insurance rates going up, unless your agent pulls your driving record, your rates will not go up. I've had at least 15 speeding tickets in the last 10 years, ranging from 6 over to 36 over, and my rates have never gone up because of a speeding ticket. But then again, I haven't been in an accident either. Those and OWI's are the kiss of death to car insurance.

Man 15 tickets in 10 years. That's either bad luck or poor judgement. :jimlad:

I'm going to take driving like an ***hat for the win.

Edit: Hmmm, who knew that wouldn't be censored.
You can speed without driving like an ***hat, really. And besides, I drive 30-35,000 miles a year, so when you break it down per mile, it's not that bad.

You can pay a lawyer a couple hundred dollars and he'll get it knocked down to a non moving violation that won't put points on your license.

If you haven't had a ticket in a long time or ever you can go and if it's within 15 mph of the limit they'll probably turn into a no-points fine.

You can hope the cop doesn't show, if he doesn't you walk out, no fine.

It doesn't hurt to try, worst case scenario, you'll get an extra few dollars in court costs. Plus the hard luck stories you hear, while you're waiting your turn are priceless.

36 over is automatic ***hattery, if it were 34 I could have let you off with a warning.

I've gotten out of several, here is what you do. Appear at court and show up early (or better yet call ahead and go a different day). When you get there and there is a break in the action ask to speak to the prosecutor. Explain to him/her that you are prepared to fight the ticket but would instead rather save everyone some time/effort and would like to just plead guilty to a lesser charge (I suggest a faulty equipment which is plausible and is a non moving violation). I would actually just show up and if the cop is not there just fight it on the spot, if he is there, talk to the prosecutor. You can tell him/her you are prepared to file a continuance and make them hold another court date and have the officer have to show up in court again and that it would be in everyones best interest to just settle. It usually works, but be prepared to pay double your speeding fine in exchange for a lesser charge. It's a win-win because the city makes more money, the officer doesn't have to come back to court again, and you don't have a moving violation on your record.

edit: some jurisdictions actually require you have an attorney to take a plea to a lesser charge, although I'm not sure how that is constitutional. If that turns out to be the case, just file a continuance and find a cheap traffic attorney to handle it. I've only run into this in one jurisdiction.

I can only think of only two reasons to be driving that much over the limit. One involves a knife-fight and some things hanging out in the air that shouldn't be, and the other involves losing a testicle.

I would think that losing a testicle would reduce one's speed. Lesson learned though, never speed on 163 through Prarie City at 3 a.m.
