responding to the question on damage deposits...

Under Iowa law, the landlord has 30 days from the tennant moving out and providing a forwarding address to either refund the entire deposit OR send an itemization explaining what is being retained and why. If the landlord doesn't do it in 30 days, the landlord forfeits its right to keep the deposit. Iowa Code sections 562A.12(3). This code section also sets out the three reasons landlords can keep deposits; 1) back rent or other funds due under the lease; 2) restoration of the property to its condition at the time the property was leased (ordinary wear and tear excepted); and 3)costs in acquiring possession of the property from a tennant who won't give it back. The law also puts the burden on the landlord to prove why any part of the deposit was withheld.

The part that screws things up is that "ordinary wear and tear" has never been defined either in the Code or by the Iowa Supreme Court. So, there are always disputes about whether or not the damage was "ordinary". One case I heard involved carpet damage in a living room of a rental house. The carpet was 1 year old and completely trashed. The tennant didn't know what the big deal was... doesn't everybody store and work on their Harleys in the living room (oil changes, etc...), especially when its cold out? I decided that wasn't ordinary.

I agree the best thing you can do is document the condition of the place when you move in. Don't just sign something that says its OK, look it over and make note of any problems or even slightly damaged areas. Photos are good, providing they have the requisite detail.

The biggest bs I saw on the lease is when your moving out, you have to have your carpet professionally cleaned. Is that for every apartment property, or just this one? and no you can't go and rent a carpet cleaner from hy-vee, you have to have it " professionally done" and proof of receipt.


That is pretty standard, and not neccesarily just an Ames thing (I've seen that in MD too). Really it's not all that much... like $50 I think.

When I stayed for 2 years at my apartment on Hyland, my landlords threw in a courtesy carpet cleaning for high traffic areas (aka wherever I didn't have furniture) for that year

That said, given 225 N Hyland's proximity to campus, I'm sure I paid more for my apartment than most... but it was as close to my classes as Friley was, and Welch wasn't that much further :yes:

Ahh thanks, didn't know about the name thing. I'm not living on Lincoln Swing, but in one of their apartments above Jeff's Pizza. Not too expensive, close to the bars and campus--sounds good to me!

They own a bunch of properties in Ames. Like I said, I never had a problem with them. They were attentive to our needs and seemed like a good management company. However that was around five years ago so things may have changed.

I was signing as soon as I saw our hot lease agent. I'm fairly sure she wasn't a lease agent because she was terribly familiar with apartments...

375+electric and heat for 5 bedroom in the University West area. Very nice place, can't wait to move in.

$639 for a 2 bedroom on corner of Lincoln Way and Stanton. Covers heat, gas, water, and internet, so we just have to add on cable and electric.

Is that your portion of the lease? Or are you that much further away from campus?

Were on 210 Gray and each pay that so I guess $1,100 per month...just down from Buchanan so rent wise I'm saving up front but have to pay water + electricity where I don't right now in Freddy.

What can one expect to pay for water + electricity each month?

Really wanted to get into the new 5 bedroom apartments on Beach but the best First Property could do was put us on the waiting list which didn't end up working out.

I think there's only 2 in the new building on Beach, and I know the people in both. There are a bunch of 2 bedrooms, a couple 3's, a couple 4's, and I think there's only 2 4+.

My water was included. I think between my roommate and I we ran about $50 / month in electricity, though we hardly had to run the heater in the winter and didn't spend much time there in the summer.

I'd expect that to be a little higher now... and it'll depend on how much you use your AC/Heater, but you can probably count on $60-$70 total / month for electric

I pay water now... and where I'm at your base charge is the majority of your bill, so if it's the same for you then it'll only varry a few dollars from whatever your first bill is.

EDIT: $70 for electric is a pretty high estimate


I'm still curious as to how the previous tenant of my apartment ran up a $140 electric bill... I know they repainted the walls in my apartment because they really needed it apperently... I'm kind of curious as to what illicent drug activity had neccesitated that change :skeptical:


(that or someone just did a **** poor job of paying their bills...)
