Sims gets deferred judgment

Probation after a deferred judgement can often times just mean that all charges will return if you get in trouble again. Its a self probation. Hopefully this is all he has to do.

Sounds like a pretty just (hopefully) ending to the situation. Looking at his record - he shouldn't have a problem keeping out of trouble for another year and a half.

There is a big difference if he has supervised or unsupervised probation. I took a deferred judgment on some traffic stuff and was officially on unsupervised probation and it didn't involve anything at all other than not getting any other offenses for 12 months. No probation officer or anyone to report anything to. This is obviously not a traffic citation issue, but it could mean a few different things still as far as his requirements going forward.

I was given a six month deferred judgment once. Long story short he can go about his normal life now but if he gets caught doing anything again, even a speeding ticket, they can go after him on the original charge. In my case they let parking tickets slide. But anything else they would have thrown down the hammer.

THANK GOD! We would have truly proved how little we care about winning to boot a player of Sims ability over something so stupid. Start him...First Game...No Question.

I am betting Sims doesn't start first game. But he might very well play. If I were Rhoads I would say NOTHING in public. Suspension is between him and Sims.

This whole thing has been pretty standard. 2 biggest predictors of conviction are criminal history, and seriousness of offense. 9 time out of 10 a first time offender will get very little in the way of punishment.

Yeah, I'm starting to think this as well. I'd prefer a one game suspension, because he did basically steal money. But he's not receiving much punishment from the courts so I guess it doesn't make much sense for CPR to punish him too much.

Strip the co-captain label, does not start the first game, and runs steps at trice at least 10 time per practice the first 3 weeks of practice.

Perhaps Rhoads is taking a lesson from what Mac did with Colvin. If Sims is absolutely needed in the first game, it would be a lot easier to put him in if the suspension wasn't made public. If he's not needed, then Rhoads can sit him the entire game. Don't know how I'd feel about this, but it is a possibility.

You guys dont actually think that players STILL run steps do you? I mean, come on....that is old school. Way hard on the knees too, especially running on all the concrete. If he is going to do any extra running, it will be gassers in the indoor facility. My guess would be that he might have to do some extra community stuff before game days.

I agree. He screwed up, received his penalty, and hopefully has learned a huge lesson from it. I'm sure that Coach Rhoads will deal with him appropriately. Not sure if this could have ended better given the circumstances.

This doesn't even seem very serious to me. If it's all repaid, he has a deferred sentence, there really isn't much more to see here. Suspend him for the first game or not, it's all good to me.
Seriously, this is ridiculous. His final charge might not seem serious, but to act like what he did was no big deal is an insult. He knowingly took another person's credit card and USED it to buy stuff. Are you kidding me? Bernie Madoff didn't really do anything either. He merely borrowed a few bucks from a few people, and it got all blown out of proportion. Is it safe to say you didn't think Jason Berryman didn't do a real bad thing only because the kid he beat the snot out of only had a cell phone and four bucks on him? I'm sure Jason would have only taken four had the victim had a couple hundred on him.

I want to win as much as the next guy. I'm happy that our best player will be playing at ISU in some form this year. Any game he plays in before the KSU game is an insult to every law-abiding player, student, and fan of the program. Come one, no big deal my butt.

You need to wake up. First, you don't compare a guy who stole millions to a guy who stole 600 bucks. Also, this is big boy football. If you are going to start suspending everyone for misdemeanors, you are going to be at a disadvantage. If you want to be mediocre I suppose that's fine but I would like to be a good program sometime. I am not saying he shouldn't be suspended. I am saying we don't need to go overboard. His captain status was taken away. Thats a big deal. When he goes to pre draft interviews, not only will he have to answer the questions, he won't be able to say he was a captain of the team.

let the legal system sort it out and don't let Sims mistake punish ISU, our fans, and his teamates. Start his ***, first game, no questions. anything less and when we finish with 4-5 wins a year for the rest of eternity you will know why. Geez, man, we almost got the BCS boot...we need to start to act and play like the big boys or you will get your wet dream of playing with ethical excellence in C-USA.

Refer to my previous post. Like I said the criminal justice system takes two things into account during the sentencing process. 1. Record(police contacts even). 2. Severity of the crime.
1. Sims had no record at all from what I have seen. This fact alone will get most offenses cut in half and then pleaded down alone, unless #2 severity comes into play.
2. Severity, He bought some shoes at footlocker. He didn't even spend over a thousand dollars. To top it off he repaid the used money before the court forced him to.

The reason he isn't doing time is because he doesn't deserve it, nor can the state afford to lock up every person that makes a foolish FIRST TIME mistake.

Everyone messes up, some of us get caught, and pay for it. I think he has learned his lesson. Climb off his back.

You normally have to get some sort of written "permit," if you will, from your probation officer.

Actually, it depends on the type of probation as it can be supervised, self-supervised, or unsupervised. With a first-offense misdemeanor, I generally get unsupervised or self-supervised probation for my clients. If it is unsupervised, he can go anywhere he wants. He just cannot have any further criminal law violations for 18 months.
