I hate the idea of file frivolous lawsuits, but given the circumstances that Lucca tried to get exposure and experience by joining an AAU type team in Germany, purposely sought out a team that gave him the best chance to serve that end and remain eligible, and the detrimental (financial) effects this ruling has on him and the ISU program because we're a "has not" in the face of a blatant double standard given to the "has" crowd(USC), we should fight this with legal action. Let this corrupt 'ruling organization' know we aren't going down on our backs!!!

I've been contemplating what such an action would look like. If the NCAA was a state actor the sanction would almost certainly be an unconstitutional ex-post facto law, as from my understanding it was just enacted this year. It would also probably be considered to be overbroad.

However, the NCAA is not a state actor, but a "voluntary" association, and from what I can tell it can get away with about whatever it wants.

By the NCAA's logic, shouldn't the entire Oklahoma football team, except for this years recruits, have to sit out a season. Their teammates took illegal money.

This is why I try not to get too invested in ISU sports (it never works btw), everytime you feel like something could start to take shape, you get your teeth knocked out. UGH.

Not a bad argument IMO, but it was largely rejected by the Supreme Court in a case involving UNLV's basketball coach (Tarkanian I think) back in 1988. They basically said that schools had the option to pull out and do their own thing if they wanted to.

How about the Fab 5 from Michigan? They accepted HUGE amounts from boosters and the NCAA looked the other way until years after Michigan made all their money and fame from those guys.

I know the Maurice Clarrett/Mike Williams NCAA reinstatement case also dealt with the monopoly power of the NCAA.

At the time, I was thinking "yeah right... we're not OSU, Michigan, Kansas, etc". I hate being right all the time.

I thought the exact same thing at the time. That's how it always goes with us. Word comes out that so and so will be in trouble. Then someone assures us that the punishment will be small. Then a month or so later out of nowhere the NCAA drops the hammer.

I just hope no student athletes park at meter with extra time on it. Seems like the NCAA would crack down on them for that too!
