He's a game changer on the field, without a doubt. He's as good as we've ever had at the position, imo.

I think this is the main reason why he's being given a long leash and I have no problem with it. I just wish that the coaches would've stayed out of it.

Also, if it's true that his charges are lesser because he paid the credit card company back, that's just completely stupid. I can't envision a scenario where what he did wasn't thought out and on purpose. Pretending to make it right after your caught doesn't lessen the offense.

Maybe it'll make sense as we learn more, but if anyone feels better about it because he paid the credit card company back, that's stupid.

After being caught, every person in the world would do the same thing. For some reason, they're not given that same opportunity.

"Hey, I stole your car. Here it is along with $9 in gas $$."

Why do you continously blow this up? Just because a fellow hawk fan of yours says that it happend doesnt mean it did. Get over it, nothing has been stated that this is even remotely true. :no:
 
You can go back and read yourself, but he was basically saying it was going to be a lot worse for David and what not. I can't remember the exact things.


I believe I said that he had charged enough & forged someone else's signature, so it could potentially be charged as a felony. I believe I also said it was up to the county attorney with what to charge him with. With paying the restitution, obviously they may be able to negotiate down the charges.

I don't think anything I've posted has been very far off. If you don't like/trust the information, don't pay it any attention. *shrug*
 
It sounds like Sims has paid back the credit card company and will probably only be charged with a misdemeanor "unauthorized use" of the credit card or something like that. I suspect he won't miss much time.

If this is true, something's just not sitting right with me. Taking and using someone's credit card without their permission, then agreeing to pay it back AFTER getting caught is serious. Hopefully CPR gets this one right. Otherwise, we'll have no room to talk about Iowa or any other program and how they handle their off the field issues.

Still a little disturbed by CPR's "even with a worst case scenario, he's still going to be on the team" comment.

From personal experiences, in these cases, the police don't even usually pursue charges against the credit card thief, even in cases where thousands of dollars were stolen. So with him both paying it back, and accepting responsibility, this is way more resolution than the police get in 90% of these cases.

Please don't anyway. Nothing is more pathetic than a bunch of fans on their high horses acting like we are somehow above every other D1 athletic program.

I don't think we are above Iowa or any other program, but that doesn't mean I don't enjoy making fun of them. Otherwise, I guess I'm pathetic.
 
Good god, I've never seen so many people bantering like a couple of 3 year olds... This thread is ridiculous. I'll wait for CW to give me the information rather then read through this arguing...

An Aggravated Misdemeanor is punishable via two years imprisonment or up to a year in jail with a fine between six hundred twenty-five and six thousand two hundred fifty dollars. In the case of Aggravated Misdemeanors, any conviction or deferred judgment within the twelve years, no matter the state, counts as prior offenses. The number of offenses against an individual increases the fines and the amount of possible imprisonment.

There have been many cases where people pay back the funds misappropriated from a credit card - it makes it simpler for the merchant. The merchant may ban you from their premises or website, however.

Aggravated misdemeanor. Wasn't that what Berryman charged with the first time when he broke the window prior to the cell phone incident?

Berryman's problem was that he already had an aggravated misdemeanor when the cell phone incident occurred. Sims better be very careful. And whatever Rhoads decides is appropriate is fine with me.

The charge could also be lowered. Usually the prosecutor charges with the highest charge allowed and then the bargaining begins.

There is nothing saying he stole the credit card. Sure using it was a terrible decision, but nothing says he constructed a plan to actually steal the card prior to using it. I am not condoning his behavior, just stating that I think there is a difference behind stealing a card then using it as opposed to finding it and using it. I have found things and not put them in the paper or on the radio. Sure, a card is different because it would be pretty easy to find the rightful owner and get it back to them, but the principle is still the same. Since h paid the money back to the company this is a victimless crime. Again, not condoning just saying this isn't something so serious that his whole life should be messed up in punishment.

Sure we are willing to sell out a little bit. We have been for awhile now.
