Right now his bail is set, however he can't get bailed out. Why? He got into an altercation with another boy. He decided to break a bottle and slit this kids throat. There is an investigation, he's looking at a min of 10 years. The other kid is alive but police said they are suprised he lived through the night.

Both parties are idiots.

If he slit his throat, why isnt he charged with attempted murder?
If he didn't have intent to kill him you can't charge him with attempted murder.

707.11 Attempt to commit murder.

A person commits a class "B" felony when, with the intent to cause the death of another person and not under circumstances which would justify the person's actions, the person does any act by which the person expects to set in motion a force or chain of events which will cause or result in the death of the other person. It is not a defense to an indictment for attempt to commit murder that the acts proved could not have caused the death of any person, provided that the actor intended to cause the death of some person by so acting, and the actor's expectations were not unreasonable in the light of the facts known to the actor.

708.4 Willful injury.

Any person who does an act which is not justified and which is intended to cause serious injury to another commits the following: 1. A class "C" felony, if the person causes serious injury to another. 2. A class "D" felony, if the person causes bodily injury to another.

If you swing a broken bottle at someone during a bar fight and everyone is drunk it is very easy to argue that he had no intent to kill him. If he held him down and sliced his throat while saying "die!" you could charge him with attempted murder.
 
I dont know how he slit his throat but someone said he broke the bottle with intent to use it as a weapon. I understand the law i guess just seems like his intent was obvious. Hopefully he gets the max of whatever he is charged with.

This was my question. How do you not want to seriously hurt him or possibly kill him if you slit his throat. If its in the process of something else and is accidental then yes but not if he broke the bottle and then did it.

So, just because someone typed "slit his throat", you guys think that's actually what happened? Just think about how hard it is to "slit" someone's throat with a broken bottle.
