Finally got through every post in this thread...

I have some questions that I think get to the heart of it...

1. Who was the accuser who appealed to Leath during the summer? Was it the alleged victim or maybe a donor?

2. Why did it take Leath so long to render a decision?

After reading through all of this, it is my humble opinion that somebody who Iowa State values has a problem with Bubu playing basketball at Iowa State. Maybe a big donor? The only reason i can fathom Leath sitting on his decision until Bubu can't transfer is that somebody told him to or they won't donate anymore. That is it... in my mind anyway.

That is the crux of the issue... who was the person that appealed to Leath to get Bubu booted a second time? Obviously Leath wasn't going to do it without an outside appeal to him directly. That precedent had been set when Bubu got reinstated the first time and Leath and Pollard didn't have a problem.

Somebody important to ISU (not necessarily AT ISU) doesn't want Bubu to play basketball... not at ISU... not anywhere. Who is it?

I'm beginning to think that Diane Stahle might have been involved in this case much earlier and to a larger extent than has been made public to this point. There has to be a reason that Bubu's legal team has called her out. Leath is the one looking bad right now, but does anyone believe that he wasn't getting legal advise throughout the past year?

What bothers me about this involvement is that she had her hands all over the infamous athlete rape case in Iowa City back in 2007. The school clearly bungled that investigation and she was right in the middle of trying to defend what they did or didn't do.

It makes me wonder if she hasn't been the driving force to try to just make Bubu go away rather than make sure that discipline is fairly applied. It's wrong to let something slide based on someone being an athlete. It would be just as bad if punishment were applied simply because someone is an athlete.

How about you explain your relentless conviction that he is guilty despite facts to the contrary. I find it troubling. Did Bubu poop in your cocoa puffs or something?

I'll be interested to see if that actually happens. There's a lot of people not happy with the guy right now.

If you are basing it off people's reaction here, sure. Funny thing is, this site isn't representative of our whole fan base as are all of message boards.

This whole Bubu mess just needs to end. It's getting tiresome, and I'm waiting for it to show up on day time tv on NBC after "Days of Our Lives"

No, I think Bubu probably admitted to an ISU official that he had consensual sex with an inebriated girl, without even knowing at the time that it was a violation of the code of conduct. If he admitted to it as justification against her charges that it was not consensual they've got him dead to rights on a code of conduct violation.

He has every right to not say anything in the ISU proceedings. He could have not even showed up if he wanted to. They can't force him to be there like the actual law could via subpoena.
Of course, but unlike criminal court, ISU could use his failure to cooperate as evidence of his guilt. That would be one occasion where it would be appropriate to ask: "What is he hiding? If he's innocent, why won't he appear and say as much?"

I'll wait, because I haven't.

He still could have used better judgement on the night in question, that is a fact. But hey, you'll overlook that.

I don't really care who's right and who's wrong. This isn't something Fred should have to be dealing with right now. I can't wait for this to end and never hear about it again.

Don't hold your breath. It is becoming increasingly clear to me - and I wonder if others feel the same way - that some people here just want to keep this going as long as possible. I have no idea what their motivation is - and it is becoming increasingly clear - that it has little if anything to do with Bubu. This whole situation is a perfect example of people using a few known facts and a huge amount of speculation - that after awhile is treated as fact - to keep this going. It's absolutely amazing. We get lathered up when the press does this - a few facts and a major bruha - but man-oh-man, this takes the cake. I am certain that many who post here are legitimate, and concerned about the situation at many levels, but if we knew the truth, there is much more here than meets the eye.

The impression I had was that she advised Leath and the BoR in their decisions. I wasn't aware of her involvement with any rape cases at Iowa in 2007 but if she was, that explains a lot. Either way, her hands are wrapped all over this case in the fact that she represented the bor in district court and she signed off on the state response in the Bubu case.

Agree. This makes ISU and the b-ball program look bad, like we don't support our players. Nationally, what people are hearing is that two judges, an ISU board, and the prosecutor Did not think there was sufficient evidence Bubu did anything wrong. Thy team wants him back.

it's Leath vs. everyone else.

I get your point, but one clarification, and obviously the Administrative Law Judge disagreed and called the decision unfounded. However, to quote the copywrited story in yesterdays DSM Register:
"The Story County attorney’s office dropped the charges, but Iowa State’s Office of Judicial Affairs determined Palo had violated student-conduct rules. An administrative law judge found the accusations that led to that ruling unfounded.

When the matter was appealed directly to Iowa State President Steven Leath, he decided Palo had violated Iowa State’s sexual misconduct policy. The state Board of Regents later backed that decision."

So, it was an appeal of the ALj appeal that Leath made his decision on. Whether correctly or incorrectly, it had been already ruled he had violated policy.

I have my opinions, but I all I am trying to do here is list what appears to be somewhat lost in the conversation.
OJA also reinstated him. This part is hazy. It is my understanding that Bubu waived his OJA hearing instead requesting a ALJ hearing. This is what all the court docs say. I think the register may have this fact wrong as they have repeated it many times but I have only seen it in the media never in court docs.

She works in the Attorney General's office. Her job is to advise state institutions like ISU. What exactly does her involvement explain?

I'm buying stock in Reynolds Wrap.

Exactly. I agree with you on this one. It surely was a tough situation for Bubu. Either you comply and answer questions or you get expelled. No jury involved at all.

That's kinda the whole issue I have with this situation.

Please understand I am not taking sides.

I just have issues understanding the motives of well educated individuals that are involved in this. I personally feel that there is NO WAY a credentialed guy like Leath has done this without some outside pressure. He didn't in the first place...

Why take 4 months to decide when you have had the same evidence on your desk the whole time?

Just another idiotic release by the administration. They are looking dumber by the day now.

They really want us to believe that Bubu could have transferred? Really? Why would he? All summer long he was STILL on the the team. So why would he transfer when he's still on the team and on scholly?

He was booted off 5 days after school started. By then it was too late. Leath purposely sat on this thing for 3+ months. Had he come out right away and booted him in June, or whatever it was, then yes, that would have given Bubu time to transfer had he wished.

What garbage.

First, the AG's brief to the Supreme Court makes it clear that the case was not based solely on the alleged victim's testimony.

Second, judges and jurors rely on the testimony of witnesses of dubious credibility all the time. All the time. How many criminals have been put away based on the testimony of slimy, dishonest, fellow criminals?

My guess, and it is entirely a guess, is that Bubu admitted to ISU officials that he had sex with her when she was so drunk she couldn't give consent. That breaks the rules, no matter the fact that she later tried to manufacture evidence for the criminal case.

I agree he likely admitted he had sex with her when she was drunk and ISU concluded that meant incapacity when the alj didnt that differently than others. I stand by my statement. No judge would rely soly on the statement of a vested party that lied and fabricated evidence. I stress solely. I also think you read the appeal incorrectlyn (or I did) as I.thoughtit said Leath made new findings but not new facts. I am guessing it was what you said.
