Troy Davis Booked for Public Intox

So who is cutting him a check for 300 to get him out of jail?
 
I can sympathize with your story here but 99.99% of the public intox cases I have seen/been a part of were warranted. I guess I have never seen someone walking home after a night out, not causing any trouble, minding their own business, get stopped and tagged with a public intox. They have always been trying to pick a fight, stumbling into the street, pi$$ing in public, throwing up, throwing stuff at cars driving by, etc.

I always thought the Ames cops were reasonable. After we had a party busted at our house for a noise violation they gave rides home to a few people that were obviously not going to make it on their own, no questions asked.

There are already crimes for most the facts you mention, and people get targeted for this all the time. It's a joke unless we want to go back to the days of prohibition
 
He must've been doing something really, really stupid. I'm not chalking this one up to "Ames cops," because usually they're pretty damn lenient. Not sure the last time we had an athlete get arrested and it was a questionable arrest.

This. He did something idiotic to warrant the charge, I guarantee it.

Jason Berryman in the bar that violated his probation. Minor in a bar but Jason Berryman was not the person causing a commotion. Ames cop recognized him and busted him. Stupid of Berryman being in the bar. But in any other college town the cops would have just let it go.

Like what? Like the poster above said, most things that warrent charges are already crimes-- public urination, disprderly conduct etc. The public intox charge is not needed.
 
A cop told me that he can arrest me on a public intoxication charge even if I had not had a drink. The law is so loose that it all comes down to the discretion of the officer. If the officer is of the opinion that you are intoxicated then you can be arrested. And yes, some police officers are pricks. Many are not.

If he did something beyond public intox, charge him with it. They didn't.

Yeah by the law, if you walk down the street acting drunk, but yet you are sober, you can get a PI.

So what happens if Troy Davis was just minding his own business and the police initiated the contact and created a situation and then escalated it till Troy responded rather than just be completely compliantly. Ames Cops could arrest thousands in the Tailgating Lots. But you can bet Pollard lets them know that enforcement is reserved for only the most extreme situations.

As was said earlier, if they break other laws, charge them with that.
 
Iowa lawmakers had apparently been working for years to change or modify Public Intox laws.

They werent able to eliminate it altogether, but seems like they modified it -- should be able to expunge it from your record if you have no violations in the 2 years following conviction
