I don't know, but I guarantee when the story comes out, he did something dumb. I'm not defending the law, but Ames/DPS don't just attest people for walking around drunk.
Of course it's the better charge to have. My point is if he really did something stupid beyond public intox, charge him with it.

You have to have multiple (want to say 3) public urination charges before you're on the sex offender list. Knew a guy in college who was on it because of that. He held it after that.I don't disagree with what you're saying, but it isn't uncommon for a cop to arrest a guy for multiple reasons, but charge them with the one that will hurt their reputation the least.
For example, if he were to be peeing in a bush, I believe he would then have to register as a sex offender. For some reason, I have it in my head peeing in public forces you to.
I've had a couple (2) acquaintances who were drunk at different times. Both times they got busted peeing in public, and were just charged with public intox.

A guy walking home from bars to Towers....he was drunk....but not confronting anyone, and just drunkenly walking home. Arrested on PI charge. So yes, you can be arrested for just walking home drunk.
