Brady Supposedly Destroyed Cell Phone

I don't know where I stand on this to be honest. On one hand **** Tom Brady and the Patriots. And it is an odd coincidence to get a new phone at such a convenient time for him. But on the other hand it doesn't sound that odd for a mega-celebrity like Tom Brady to destroy an old phone and/or SIM card when he gets a new one, I imagine his personal phone contains personal information he would rather stay personal.

I think it's not as cut and dry that the league wins this case, they're basically saying that players are forced to give up any and all personal data or information whenever the league requests it or they will be suspended.

It's all about the personal conduct policy that Brady agreed to as a term of employment. The commish gets pretty broad power to punish if he feels that a player has impugned the "integrity of" or "public confidence in" the game. If it's simply refusing to give up his phone, I think that's one thing. But if he's destroying the phone, right before he was set to meet with the investigator? A phone that he and his council knew had been requested as part of that investigation? That's another thing entirely. That is not the action of a man with nothing to hide.

You think the NFL WANTS the fact that one of it's biggest stars and most important teams is being accused of cheating during the playoffs to STAY in the headlines all to cover up the fact that they do not want Seau's family to speak? Oh, dear. The Patriots thing is WAY WAY WAY worse than the Seau thing.

A phone that they have no right to have access to? I get the not cooperating thing and a punishment of some kind, I just think when this goes to Federal court it's not going to go as swimmingly for the NFL as you guys think.

I would not be shocked in the least if it gets knocked down to just a fine after all is said and done. If nothing else because the 4 game suspension is completely ridiculous given other comparable situations, Favre didn't hand over his phone and failed to cooperate with an investigation and got a $50k fine.

You are under the mistaken belief that this is a court of law. The NFL doesn't need irrefutable proof. They have suspended players for far less than this, including arrests that were thrown out of court.

Favre wasn't accused of cheating to win an NFL playoff game.

I know I'm in the minority here, but I think this will be a slam dunk for Tom Terrific. The league is fining him $ 2 million for defalting the balls. His lawyers will ask the court for the NFL's proof. They have none. They did not record the psi readings. The NFL now instituted rules after the fact which admits their procedures sucked. Roger's sloppiness will be exposed.

Do I think Tommy is guilty? Sure. Will the facts show it? No. Saying Brady wouldn't cooperate or making a big deal about his phone will not be of much interest outside of the NFL kangaroo court.

Tom Terrifc may be asking for federal judge to rule on the suspension/fine. The judge's ruling will be based on the law, not Shifty Roger's NFL interpretation.

Interesting move by the NFL. They filed a motion in a federal court in New York, asking them to affirm the suspension. That gets out in front of Brady, and the NFLPA, and forces them to fight to even get the venue moved to Minnesota, where they've had so much success against the league. Who knows what the track record of the NY court is like regarding cases like these, but it can't be much worse than David Doty (from the NFL's perspective)

The NFL suspened/fined Brady under their rules for deflating the balls. The Federal court will ask for the NFL for the proof that their ruling was based on.
It will intersting to see how this plays out, but I think the court will rule Shifty Roger was outside of his authority because he will not be able to produce the psi readings of the footballs.

Exactly. The phone company could still retrieve records if he had to give them up which he doesn't.
