Brady Supposedly Destroyed Cell Phone

The problem Brady has is that he has not been helpful in the investigation and has not cooperated. THAT is the problem Brady has. And that is likely the reason for upholding the 4 game suspension. The league can do it. And he can appeal it and play in the meantime. But the suspension would occur later then. Brady and the Players Union are holding out for just a fine and no suspension.............and no cooperation.

And again, with all the research that's finally starting coming to light regarding concussions over the last 10 years, I think that was the HOF/NFL being proactive more than anything else. I don't think it would be surprising to learn that the NFL knew cases like this were going to start coming their way in the near future and tried to cut it off at the pass with regards to the HOF. They've certainly showing a willingness for deceit every step of the way so far.

Take that "report" with a big ol' grain of salt as it came from Stephen A Smith. If it came from an even remotely credible source it'd be different, but this just looks like typical SAS bluster.

Maybe the ball boy cell phone was destroyed too?
 
If Shifty Roger stands pat with his four game suspension, Tom Terrific will undoubtedly take him to court. He's out $2 million so why wouldn't he? With the NFL now implementing several ball control rules after the fact (that should have been in place years ago), the chances Tommy winning in court are heavily in his favor. The NFL has no record of their psi checks so the court will them, sorry guys, if it isn't written down, you didn't do it.
 
they'd still be talking about one of the nominees, right? I'm saying they wouldn't be talking about the nominations at all, it would completely be a concussion discussion, and those have been had already and will be had again. Talk about it during every NFL broadcast if they must, but to me they can afford one day a year to leave it alone.
Poor HOF Nominees, when will it be their turn to get noticed? Oh wait, their making their own speeches as their inducted into the Hall of Fame.
 
Looks like Brady has the NFL in bunched panties with the ongoing discussions and most probably lawsuit.
 
I took a screen shot of ESPN.com early spring that had SIX photos of Brady just on the top half of the front page. Can't find it but you just have to laugh. Regardless of the topic, tabloid drama is more popular than actual events.

On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cell phone he had used for the prior four months be destroyed. He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. During the four months that the cell phone was in use, Brady had exchanged nearly 10,000 text messages, none of which can now be retrieved from that device. The destruction of the cell phone was not disclosed until June 18, almost four months after the investigators had first sought electronic information from Brady.
Based on the Wells Report and the evidence presented at the hearing, Commissioner Goodell concluded in his decision that Brady was aware of, and took steps to support, the actions of other team employees to deflate game footballs below the levels called for by the NFL’s Official Playing Rules. The commissioner found that Brady’s deliberate destruction of potentially relevant evidence went beyond a mere failure to cooperate in the investigation and supported a finding that he had sought to hide evidence of his own participation in the underlying scheme to alter the footballs."

And Brady will lose there. Brady did not cooperate with the investigation. Goodell lhas used his non-cooperation as a valid reason for the suspension. And Goodell has said that if Brady would be forthcoming and reveal new information that a reduction of the suspension would be considered.

Since Brady has not cooperated, the suspension will likely be upheld. And since the league can give the suspension for not cooperating, then Brady could likely lose his case.

Brady destroying his phone on the day that he was to be interviewed by Wells is going to be a hard one to overcome in court, I would think. It's now not about deflating footballs. It's about non-cooperation with the league, and obstruction of their investigation. And while he was under no legal requirement to comply, he certainly can be punished by his employer for it.

Just as steroids are part of baseball's history (for better or worse), so are concussions in football. The HOF is a museum, and to pretend that this issue doesn't exist is a fool's errand. They had no problem letting families of deceased players speaking before; the rule has only been in place for a few years (pretty convenient, considering that the NFL has seen the research over the last 20 years and could surely know that there will be more inductees like Seau coming down the pipeline now that there is more public awareness of the issue).

And how would this be unfair to the other nominees? As I said before, families of deceased players were allowed to speak before, and they didn't get rid of that because it was unfair to the living players.

Because what they would hi-jack the HOf induction and turn it into a concussion discussion, that would take away from the inductees into the HOF.. Kind of simliar to this thread about Tom Brady's cell phone getting Hi-jacked to a HOF/concusssion thread.
 
I don't see Brady winning in court now, didn't see him winning in court before. It is his employer, if he doesn't want to cooperate with the investigation that is his prerogative, but he has to except the punishment based on the evidence the league does have.

That said Goodell is a goddamn mess and I really hope the NFL smartens up soon and gets rid of him. But I am not holding my breath because the cash just keeps rolling in.
