ftfy. a fight between two people should not result in APD going to defcon 1. Its called having an appropriate level of response, and APD fails in this. An excessive level can inflame the situation.

Any act which is intended to place another in fear of immediate physical contact which will be painful, injurious, insulting, or offensive, coupled with the apparent ability to execute the act.
The state has to prove all of it, not just part of it.
"Do they have fists they can hit you with?"
"Yup"
"They had the ability"
Hell, spitting on an officer can be ruled assault. Most have that ability.
Not by closing off bars from entry AND exit, and harassing and yelling at people a whole block away down near lincoln way, that's for damn sure.

Have you ever come into contact with law enforcement? Did they arrest you due to this code?
If not why?
Using your logic LE can arrest anyone who because they have the ability to to execute the act (having fists). What happens if the person didn't do any act intended (aggression counts here) to place another in fear of immediate physical contact which will be painful, injurious, insulting, or offensive?
Thats the thing.. the ability (such as having physical ability), combined with the 'f-you' (calling that the aggressive act), can create the fear+the ability required to meet the minimum.
Ive had a girlfriend harrased by police when i was in ames.. they dont always do the right thing, but i tend to think that athletes can stay out of trouble if they want to.
she was removed from our car in middle of afternoon... they wouldnt let me get out and they put her through every test you can imagine... acting like she was drunk or on drugs... mind you she has never or had ever even sipped alcohol before... i couldnt take it, got out of the car and they jumped back in the theirs and drove off... no word. so they dont always do the right thing. this was in 2000 right on duff.
I got pulled over for speeding last year in Coralville. I was speeding, I accepted responsibility for that and paid for my ticket. But the cop asked to search my car because he said he saw me take a drink from a bottle. I hadn't had anything to drink in a couple hours, and that was a Pepsi. He didn't see jack ****, he just wanted to search my car in hopes of finding something. I let him search because I didn't want any trouble and I knew he wouldn't find anything (and he didn't).
But don't tell me that cops aren't sometimes ****s "just because".

Ok. Not literally anyone. But for the high level of power that any police officer has, the qualifications for reaching that point are relatively easy.
Now, to be an officer in a large community, you have to prove a lot and be good at what you do, but it takes very little training to be an officer in a small town.
As someone pointed out earlier, there's a huge difference between police in large towns v. police in small towns.
