CLARIFICATION ON TRANSFER ISSUE IN PALO CASE
Recent published accounts have suggested that Iowa State University delayed a decision in the student conduct case of Bubu Palo, which prevented Palo from being able to transfer to a different institution. The following information is being provided in an effort to provide clarification on the transferability issue.
- The Iowa State University President’s Office provided notification to Matt Boles (the attorney for Palo) on Aug. 21, 2013, that President Leath’s decision would be provided within 10 days. Boles acknowledged receipt of the notice, and did not raise any concerns with respect to the decision timeline.
- President Leath issued his decision on August 30th.
- There is a process, within the NCAA governance structure, that allows for student-athletes to transfer to other institutions. That process is available to student-athletes seeking a transfer even after classes have begun at their present institution.
- After the August 30th decision, Boles contacted Athletics Director Jamie Pollard to ask if Iowa State would support a waiver to transfer. Pollard shared with Boles that both President Leath and he would support a waiver to the NCAA. After that point, neither Palo nor his attorneys ever provided Iowa State University with an official transfer request.
