You could probably also add trespassing and obstruction of the roadway.


I would try to argue intent to harm as well. Could driving over pumpkins harm the car and/or the person? Assuming this was a night too, so hard to see them Could cause serious injuries if it made the car swerve.
 
Do we all agree the Hoiball92 is probably a bored-a**ed guy? Probably in his twenties but not definitely in his 20's and probably has a somewhat serious drug habit. The drug habit would most likely be a stimulant which would contribute to this angst. Having sociopathic tendencies would also cause him to make up these ridiculous comments (troll attempts) and contrived "real-life" events (embellishments at the least, out-right falsehoods at the greatest) that are put out there purely for the purpose of eliciting a response, any response.

I fell into the trap of commenting on one of his pumpkin posts and now realize that I made a mistake falling into this trap. Stating that "smashing pumpkins isn't illegal" and "if it was a real crime they would send real police" was simply too much stupidity (and trust me, I know something about stupidity) for my self-control to overcome. I just couldn't hold off any more. I am disappointed in myself.

Having purged myself (thank Angie for the purged verbiage), we are going out for dinner with a group of neighbors at a restaurant we haven't been to before and a comedy show tonight. Anybody else have plans for the weekend?

We're taking Z to her first birthday party invite. So I hope that goes well. It will be at an apple orchard. I think the one with the jumping spot and the corn maze.
 
Sitting here wrapped in a blankie fighting my laptop. Alternating fever & chills with a happy combination of joint pain & general lethargy. Dreary day outside doesn't much help my mood. I went to bed around 10.30 last night, got up around 6, emailed work & went back to bed for four hours.

I don't think flu shots like me.

We had a blast at the apple orchard this year. There is so much to do and it is always such a relaxed and festive atmosphere.

I don't know the statute but that one might be tricky. Unless there's some evidence that he meant to cause harm/damage it would probably be difficult to prove. But it all depends on what the statute says.

That sounds like fun! What'll the weather be like?
 
I remember a few years back it was so bad in Ames with the pumpkins that people started spiking their pumpkins with toothpicks so that when the thieves (YES, BDK, YOU ARE A THIEF) grabbed the pumpkins the toothpicks poked them. Don't know if it worked or not. Ames people, do you remember this? Or is my membry broken again?

Right! So I don't know how the party part will work. She'll want to run and explore everything. It's a single party for two siblings who are 4 and 6 I think.

We went for pumpkins and Christmas trees (different places) a couple of years when youngest son was here in school with a wife & 2 daughters. It was fun...but one of the tree trips was really COLD that day. The little ones were NOT happy that trip! ;)

boo :( I know that scientifically that isn't supposed to be a thing, but it sure seems some people have trouble with it. Did you get the live virus version?

So the Nancy thing got me to look up my name. Boxster is even more out of vogue, at least as spelled for me, than Nancy. Like 150 people with my name the year I born. 5000 with the alternate spelling which explains everyone always misspelling it I guess.

Dead. I'm not a good option for the live attenuated due to the lung problems last spring. I'm apparently one of those lucky ones that gets relatively mild side effects. The first two times I had flu shots (late 70's, I think? - swine, or London, or HongKong varients, iirc) I got the same stupid reactions. I decided to forgo the vaccines when they really started pushing them because I was in good health, I was low risk, and I wasn't continuously around people who are high risk. Well dammit...I'M high risk now, so yeah. Doing the vaccine thing, feeling crappy joint aches/fever/headaches for a couple of days (and whining about it!) but it's better than the alternative. Don't want another fun week like last spring. :)

Sore arm or not, I'll be doing this every year from now on. So take that, colloidal silver fanatics. ;)
 
Not necessarily. We all go through a character fitness thing (where you need to disclose everything illegal that would show up anywhere) but something like this isn't going to keep him out. Now BDK, if you were caught, went to law school, and didn't let them know, you'd probably be royally ****ed. Because the bar would find out you lied to the law school and them and good luck being admitted after that.


Cybirdy probably has it right with theft. Probably also trespassing. At least, if I was a DA and I was going to charge him, that's what I think would be the best fit.*

and BDK, you probably shouldn't disclose criminal actions on a message board. Just throwing that out there

I know that people who have committed crimes can gain admission to the bar. I was just saying law school might not be a good fit for someone who doesn't recognize the criminality of theft. It...kind of suggests a fundamental misunderstanding of criminal law.
