ISU did not appeal this. The State of Iowa did. Think there's no difference?

I'm not sure that I would want to be a student at ISU if this is how they are going to treat their students

There's a pretty big difference between "could" and "will" though.

They can think that all they want, but it was an entirely unjustified personnel decision as was decided by a judge who had the authority to rule accordingly.

Remember, Leath cited the university athletics code of conduct as reason for Bubu's dismissal. The standard is definitely lower there than a legal standard of being beyond a reasonable doubt in a court of law. He may have been dismissed for reasons altogether different than those the district attorney charged him with. We don't know. Leath has declined to say, citing privacy. But considering this athletics code is presumably being selectively applied, it opens the door for the kind of legal squabble this has turned into.

If I'm Hoiberg, I could care less. He has nothing to do with it, other than he might have a kid play for him or not. The kid hasn't been on the team all year, so what difference does it really make? Just think of it as a player in the NBA who's hurt all year, and may or may not come back. Or a player fighting a league suspension. Would Hoiberg leave the Timberwolves if the NBA suspended one of his back ups?

Hoiberg knows he is going to take absolutely zero blame for any of this. He can just wait out the administrators. Cyclone Nation ($$$$$$$$$) could care less who the president is . They care about Fred Hoiberg. When public anger boils over, politicians will cave.

The judge has not decided that. They judge stayed the dismissal while the case is being heard.

You can't be serious, right?

What does Hoiberg tell recruits that ask him what will happen to them if they break up with a chick while at ISU and she falsely claims they raped her? Will Iowa State support me, or will they do to me what they did to Bubu Palo?

And if this leads to Hoiberg not being able to get good recruits to come here because they don't feel they will be supported here, and the team falls flat on it's face, do you think Fred is going to stick around to go down with the ship and let his coaching reputation suffer for it?

C'mon, you MUST be smarter than that, right? You honestly don't see any scenario where this could harm Fred's ability to recruit? And if he can't recruit and is strapped, you don't think he'd jump to the NBA? C'mon. Think!

(1) AS other have said, it is a moot point whether it is ISU or the BOR. The BORs actions are consitent with ISUs statements following Palo's reinstatement. So until they come out and say they considered it settled that Palo was back, you can assume at least tacit agreement and probably cooperation with the BOR.

(2) Maybe it is about "precedence", but this appeals process was established...criminal court/county->Office of Judicial Affairs/Pres Leath -> BOR -> Admin law judge ->IA Supremes. The "Judicial Review" questions seems like it should not have come as a surprise or be in dispute?

(3) It seems ridiculous they did not just expel him, if they were not going to complete the process in time to transfer. If the conduct was so bad to not represent the school, why allow him to stay on scholarship?

The ISU judicial process is separate from the criminal court proceedings. If you've already been to court for the alleged incident, then you have fulfilled your obligation to any violation of Iowa Law. You have not, however, met your obligation for Iowa State University policy. Even if the courts found you "not guilty" or determined there was not sufficient evidence to hear your case in court, you must still meet with an Office of Judicial Affairs staff member to resolve the matter with the university.

Can ISU take judicial action if the incident took place off-campus?
Conduct off-campus which violates conduct regulations and presents a clear and distinct interest of the University is subject to disciplinary sanctions. Section 4.1.3 of the Student Disciplinary Regulations provides further explanation.

What can I do if I do not like the conduct decision made at the end of my hearing?
The appeals process is clearly outlined in the Student Disciplinary Regulations in Section 6. There are specific criteria upon which an appeal may be filed. Depending on the type of hearing in your case, the appeals process will be different.

It is not a final decision by any means, but don't ignore why a stay is granted. A stay is granted in part if there is a good likelihood (based on the evidence, or maybe in this case the lack of it) that the person asking for the stay will win his/her case going forward. The stay is also granted so as to prevent further harm or damages to that person until the case is actually decided.

The judge is certainly not staying the action because he thinks it was proper.

Good lord some of you are really freaking out about this. It obviouslly became a p oltical ******* match a long time ago. My problem is that the Acuser, who obviously has some clout, never has to come foward. They are taking action against a student and don't even have to show thei face, they are the cowards causing the problem.

I'll make it more clear. If this goes to trial, which now looks very likely, and the trial becomes national news, as it will, then it "will" have bad repercussions for ISU athletics as far as recruiting players and coaches. Our president and a.d will be pitted against an ISU athlete who is not only innocent of any crime, but is a two time academic all big 12 basketball player. I've explained why it would be bad for coaches and recruiting in a prior thread, but there are other reasons I'm sure I haven't even thought of.
