David Sims charged

Still don't consider it as bad as driving drunk. Maybe the standard suspension for that is too low, but you can't sit him half the season for this and sit someone 1 game for DUI.

Obviously he may have family/friend resources, but I'm curious how he was able to pay back the money so quickly.

And, what shoes at FL cost $230? He bought two pair of these...was he required to return this merchandise?

Having read that article I am extremely disappointed in what I have heard about how the Simms situation will be handled by the team. IMO, 1 game is not nearly enough.

Maybe Rhoads isn't what I thought he was.

What have you heard about how it will be handled? Right now there is an indefinate suspension.

What are we looking at, 700 bucks? I am sure he knew someone with that money laying around. It's not like he bought a car.

I'm an Iowa fan, and I'd be more than satisfied if it was 1 or 2 games (though I believe your 2nd game is the Iowa game, and I don't want Sims to miss that one), a fairly hefty fine (at least equal to the amount that he allegedly stole), and a ton of community service. That's what Iowa guys get for a DUI (which I can't stand. They should get worse than a slap on the wrist for that), so I can't sit here and say that Sims' punishment should be harsher than that.

First off - wow a realistic hawk fan and i agree 100% with your assessment. I agree there needs to be discipline and i agree that its typical that hawks get slaps on the hands for lesser charges....which can lead to the belief that they can get away with things because they play ball...

Sims is suspended indefinitely, according to the school’s discipline policy for athletes. The code for first-infraction situations like Sims’ states that:
The student-athlete shall be indefinitely suspended from competition and may be suspended from practice.â€￾

To me - this is the one telling difference in how the two universities handle these issues differently.

At Iowa - regardless of offense, the first comment is always "We will do an internal investigation and wait for the legal process to run its course". The whole time, the student athlete is treated as if nothing happened, able to maintain practice, playing time etc. Now there are instances that the overwhelming evidence has showed the severity of the charges and evidence calls for removal, this is definitely not typical.

At ISU - the Student-Athlete Code states: "For first infraction situations, the student athlete shall be indefinitely suspended from competition and may be suspended from practice".

Case in point, the Adrian Clayborn case and this case are really quite similar in severity of charges if DS pleads down which is expected - both will be simple misdemeanors....AC plays the entire season while the "Legal process runs its course". At ISU he would not have had the option - he would have automatically been suspended, wonder if he would have pleaded down earlier thus actually get suspended rather then not getting any suspension. Remember folks, his original charge was Assault - he got zero games suspended!!!!!

You will see, AC will not be suspended, nor will he miss any practice time. DS is already facing suspension.

So Any Hawk Fan that wants to justify the differences please do so....

IMO what should happen is the Board of Regents which governs all public colleges in Iowa should develop their own Student Athlete Code of Ethics - and the AD should be tasked with enforcing it. That takes the power to suspend or play out of the Coaches hands, after all, they're rewarded financially for success, why wouldnt they want their best players on the field if at all possible???? We as fans, sponsors, boosters etc put the importance on winning - and more times then not have and will sacrifice selling our ethical sole to the devil for success.

I for one, really hope to see Sims gets at least a 1 game suspension, had he not stepped up and admitted guilt, i would have said a minimum 2 game suspension. Dont take that wrong either, he's by far and away the most exciting player on our team and i'm a huge fan. But, i want to do it the right way at the same time...and it is possible, but this will be a proving ground for Coach Rhoads....Good Luck Coach!!!!

Yeah, after reading that article, it appears to me David is not the sharpest knife in the drawer. Extremely stupid, borderline ******** thing to do.

I think it's worse than driving drunk, as being a thief goes to someone's character.

Again...I said what I HEARD. Obviously nothing is final yet. But I HEARD 1 game.

I disagree with that as a punishment and agree with the victim that legal penalty he will likely pay is not nearly stiff enough.

I don't care how good a football player this kid is. He is a crook plain and simple.

You're judging someone from scant reporting in the register/ames trib? I personally doubt the woman's son didn't know the card was being used.

How would you track the items to Sims, gas and shoes, without knowing who had the card? If he randomly found the Credit Card on a sidewalk, how would they have a search warrant within a few days? Someone who had access to the card, knew it was in Sims' possession.

Hell, on KCCI right now, they're asking to identify 2 people via security camera. Somehow Ames police are faster?

I don't buy it, there's gotta be more to this story.

And congrats to David pleading guilty to face the punishment.

How about we wait until all the facts come out and he's found guilty before we call him a crook and assasinate his character? Then all of you guys that never did anything dumb and illegal when you were young, never took anything that wasn't yours no matter how small, or never cheated even just a little on your taxes can rip on him.

It is a FIRST offense. He made restitution. He has accepted guilt in the matter.

I would expect it to be handled for anyone else given the circumstances in the same way.

Being stripped of his Captain Status and a 1 game suspension would be about right for this First offense.

Anyone wanting more is just being overzealous. Good grief. We had a sheriff, several years ago in our county, embezzle over $100,000 from the county. He hasn't even made full restitution yet. And got probation and merely had to resign his position.

Apparently if you think stealing a credit card and using it is a crime, you are on a high horse. And I love your brand of reasoning there, kinda like the OJ case. If the $230 shoes don't fit, you must aquit.

I have to assume these posters are just jerking around now...as there is no way they still want more proof on this matter. The combination of all the linked articles and the info provided isn't enough for you?

He found a card, made a choice to use it, got away with the purchase of one pair of shoes, shopped at JcPenney's, wasn't satisfied (apparently) with one pair of shoes so went back for more. Fear, and counsel, is what motivated him to pay back the money, not any set of sudden ethics.

No one said it isn't a crime.

The point everyone is making is that it was his FIRST offense. He has made restitution. He has accepted guilt. He will pay a fine. He will be put on probation. That is usually the appropriate sentence given his circumstances.

From the football side of things, which is a completely separate issue, he has been stripped of his captain status, and will sit out 1 game. Again, that is a coach's decision. But I feel it is appropriate for this young man's FIRST offense. And his acknowledgement of guilt, restitution, and legal penalty.

Like I mentioned. We had a sheriff embezzle over $100,000. He has NOT made restitution yet. He merely had to resign, which is understandable. And was given probation. What do you think of that?

I think it is ******** when anyone breaks the law and doesn't pay for what they did.

EDIT - Breaks the law, is stupid enough to get caught, and doesn't pay for what they did.

You make it sound like he eventually felt remorse and turned himself in - he did not. He was caught.

Are you serious?

How about "congrats David. You found a card that wasn't yours, didn't use it and turned it in to proper authorities or notified that card company that you found a lost card".

There's no "congratulations" in order here.

Funny how he's a stand up guy after being caught, and not before.....

The irony of this is - Sims steals and uses a credit card...many fans think zero or 1 game suspension is perfectly fine.

Months back when Iowa FB players (and wrestlers) were getting busted for public urination, public intox, etc - KF was not coming down nearly as hard as he should have on them.

Our sheriff didn't turn himself in either. He got caught and then showed remorse. That is kind of the way it always is. I don't really know of anyone who turns themself in without being caught first.

Aiello got zero penalty for sticking a pool cue in a guy's eye. I consider that worse than what Sims did.
