Wait, so in this scenario, the athletes performs the same function as an ad agency?
I don't think that's how it works. The athlete isn't creating the advertisement. They're participating in it. Why would they get sued? They're just an employee of whoever is creating the advertisement, likely another ad agency.
I'm not defending the litigation. Just predicting it.

I guess the potential threat of frivolous lawsuits is fairly low on the things I'm worried about with this change.

I do see some legitimate complaints. As I said before, State employees cannot use their position to compete with private companies.

There will be issues. Some will be legitimate beefs, some will be frivolous. All will cost a lot of money.

Not that I am criticizing the legal profession, mind you...
