Well that doesn’t sound great. Even if this was initially consensual, the alcohol and marijuana given to minors quickly ends that notion. Add in the pictures and the DA should be able to just name the number of years served.

But, on the face, it seems PSU is handling this correctly this time around. Remove the players and let the legal system throw the book at them. There’s nothing from a team punishment that would come close to being enough to keep these guys around.

Seems like an awful case that Penn St handled appropriately.
I'd imagine the cell phone data will be huge in this case.

Also filming a 17 year old having sex is child pornography. These guys are looking at life sentences and deserve it if they are found guilty

I feel like a DA will tear the defendants apart with this:
"Lyons expressed the belief the contact was consensual; however, Lyons reported having an awareness the victim would likely report the situation to the police," the affidavit said.

For once stupid pictures will be a positive kinda. Help to provide evidence against these jackwagons.

It’s the possessing vs producing thing. In this case, these guys filmed an act. To me, that deserves the higher sentence and should be taken into account when sentencing the act itself. But in totality, there should be nothing short of 20-30 years for this.

I am not sure. However, if you add in the rape charge, child porn charge, and the other charges. I assume you have to be getting close to a life sentence.

If the footage (or other evidence) proves rape I’m all for throwing the book at them for rape, but a 17 and 19 year old having sex and filming it is not the kind of predatory child porn creation that deserves a life prison sentence.

Statutory and child porn laws like this have been used to destroy the lives of young black men in the past even when it is proven consensual sex between people of effectively the same age. Genarlow Wilson is a famous example.

feels like the title of this thread needs changed- (Former Penn St Players Charged with Rape)

dont necessarily think this is a Penn State issue, just so happens that 2 (former) players were charged. This isn't a "scandal" at Penn State.

I'm not sure what the scandal is here. Sounds to me like these guys did what they did which unfortunately happens far too often and they were handled in a very reasonable amount of time. A coach speaking on it is not only something that's not really necessary, but probably ill-advised. Like, I don't know what people would want him to say that would mean anything.

Plus it's James Franklin and he really needs to not talk about anything of substance since he's a dumbass.

But these guys got kicked off the team soon after this happened. It’s only getting notoriety now cause Franklin won’t comment on it and the local reporter wanted a “gotcha” moment imo.

But what exactly is he supposed to say? It’s a legal case at this point. The proper thing to do is offer a “no comment”. He got in big trouble at Vandy for opening his mouth too much in a rape case. So, I’m sure he doesn’t want to F up like that again

But taping the non-consensual act even between two adults seems like a "throw the book at them" sentencing. First they could publish/share the video. Second, I have to imagine making the video is with the intent of watching it later. To relive the brutality on the victim.

If guilty, I hope they both go away a long time. Not life, but 15+ years.

After Wednesday's practice, a reporter started to ask Franklin about the criminal case. Franklin walked away from the microphone, and a university spokesperson read a prepared statement: "Regarding the two former Penn State football players, we released a statement yesterday and our program and athletics department will have no further comment."

When another reporter attempted to ask Franklin about dismissing the players, he walked away again.

"Again, guys, the university already released a statement," the spokesperson said.

Weird way to handle it, can he not be trusted to say that himself?

Yeah this doesn’t qualify as scandal, there isn’t a cover up, seems like everything is being handled properly. Franklin probably wants to say something but is being instructed not to.

Hope they get the maximum punishment

My point was the statutory and child porn laws are wielded at young black men sometimes regardless of consent. The example I gave was hs kids where all of them were 17 or younger and the kid did hard time, happened to be a college fb prospect. I hate even bringing it up because I’m not defending rape and assault or actual child porn.
