We need national paid leave in this country so badly.

My SIL got let go from her job (the same one that had a kid with Tetralogy of Fallot) because they wouldn’t let her take time off for her sons heart surgeries. No paid time off for birth and no FMLA. The US is stupid with this ****. They’re scraping by with the go fund me money my wife set up for them.

Is there a size limit with FLMA?

No FMLA due to length of service? Or already exhausted?

Size limit for employers requiring it is 50. They were under that.
Why is there a size limit for FMLA. It is unpaid right?

What company. I would just like to know so that I can be sure to never do business with them.

I’m not gonna blast them in respect for privacy but unless you’re a CPAP wearer, it won’t effect you.

And just FYI even if it's unpaid doesn't mean a company can't let it go longer. I took 14 and 16 weeks with my kids, mixed with work days. About half was unpaid.
Not to get too political, but this is why it needs to be a federal program. It isn't fair to small companies to absorb the cost of paid leave but it's even more unfair and inhumane to not be able to give grace to people during the hardest times of their lives.

And because this is my soapbox, I'll point out fmla was originally supposed to be 26 paid weeks, on par with many other wealthy countries at the time - in 1992. It got whittled down to 12 unpaid and many, many carveouts, including the 50 rule. The intent was that it would get improved over the next few years. And here we are. Literally alone in the world with a couple island and Sub-Saharan countries that have no national paid family/maternity leave.

Why? Because it's in the best interest of small businesses to have employees at work. #corporatewelfare

A business that's worth its salt should be able to work out something with the employee.
