If you've never been, this place is kind of fun. It is a basement bar in Milwaukee that you need to know the password to get in. If you don't, they make you do stupid acts and the whole bar is watching from a hidden camera (so I have been told . . . )

Why, yes, that is true. Just look around before you go and you'll find the password. If you can actually find the place, that is.
 
President Wintersteen just sent an email out to all students indicating that, effective immediately, all on and off-campus gatherings must comply with all health orders (masks, size limits, 6 foot distancing), and students who do not comply will be subject to university discipline including suspension. Then the ISU Alert system was activated to warn students to comply.

Not sure how much impact it will have, but I give lot's of credit to the ISU administration for trying desperately to keep from having to shut down the in-person courses.

I agree with Wintersteen on this, but....I am not sure that legally a public university can suspend students for off campus activities that aren't against any laws. That is a decision that could potentially impact the rest of someone's life and potentially cost them millions of dollars over the course of a lifetime career.

Like I said, I like the sentiment, but that is a very slippery slope and people still have rights in this country.

Disorderly Conduct

5.9 Disorderly conduct is defined as any unreasonable or reckless conduct by an individual or group that is inherently or potentially unhealthy or unsafe to other persons or their properties. Any unruly behavior or unauthorized activity that significantly disturbs the academic pursuits or infringes upon the privacy, rights, privileges, health or safety of other persons or their properties is prohibited.
5.10 Endangerment
The creation of a hazard or otherwise intentionally or recklessly endangering the physical safety of self or others or property.

Pretty sure the student code of conduct generally can include behavior off campus.

Bans on hazing would seem to come to mind as a ban for activity that occurs off-campus and covers behavior that is often still legal.
 
I'm assuming that ISU is wanting to scare students into following the rules, particularly as Ames is apparently trying to enforce masks. This might be an issue if police end up writing up a few of the more massive house parties. Do you still get to collect tuition from a suspended student?

Legally, there is a zero percent chance that a court would uphold something that broad for simply gathering. They would need something more specific than attending a party. The language of "significantly" is where I would start.

Most students wouldn't have the time, initiative or cash to fight it, but someone would and they would win.

A decent lawyer would carve the ISU up for suspending someone for attending a party.

That's funny they are now going to enforce that. I can think of dozens of things students do in housing that significantly disturbs and infringes upon the "privacy, health and physical safety" of other students. Like shaking the house until 5am for starters. Hard to study when you can't get any sleep eh Wintersteen?

Last week masks were required until you were actually in the room. Don't know about now since brilliantsteen sounded the emergency broadcast system.
 
Pretty sure the bar owners were given a stern warning by city council to follow emergency health guidelines (50% capacity, etc.) or lose liquor license.
