    None of this has to do with what is considered ‘illegal’. It’s contract law. By accepting an NCAA scholarship the athlete agrees not to accept NIL that isn’t vetted by the clearinghouse. The restraint is on the athlete, not the booster.

    The booster can’t give him $5M under the rules. That’s the point. The athletic departments desperately want that money back in the athletic departments coffers (including Big 10 and SEC)..

    I think you may be confused on what is being assessed for FMV. It’s third party NIL deals to promote third party business. iSU’s budget has nothing to do with the assessment, nor does football viewership.

    The clearinghouse really isn’t the legal issue. The issue is whether the cap itself satisfies antitrust law. This district court judge clearly believes it does but we’ll see if other courts will in ancillary attacks.

    The SEC and 3 other big 4 conferences are PARTIES to the House agreement. They negotiated this arrangement.

    Teams can’t ‘promise’ NIL. That would violate collective bargaining agreements. I’m sure they could mention their market has better opportunities for endorsements but that’s about it.

    Legal challenges won’t have anything to do whether the valuation is ‘fair’. Follow-up litigation will involve whether the salary-cap violates antitrust law in the first place.

    It’s based on the salary cap. Basically they are ensuring that the salary cap isn’t being exceeded by illegitimate NIL deals. If the salary cap survives legal challenge, i would expect it’s enforcement mechanism to survive too.

    Well our coaches will be walking away soon if we don’t pay our athletes on par with our peers. So we have that going for us.
