Forget the under the influence. Killing someone for going 80 in a 35 should be enough to put you away for a while. It sucks, because I know a lot of good people who did similar dumb things at that age and didn't get caught, but that doesn't mean there shouldn't be punishment when the dumb decision results in tragedy. I actually know someone who had similar situation and went to prison for quite a while. He turned his life around and now goes around and gives talks about his experience.

If he's a good person, living with the guilt of taking a life will cause him more trouble than going to prison. As much as situations like this suck, I feel for the other party involved. I couldn't imagine living with that feeling that you took a life due to irresponsible behavior.

Depending on the state. Some prisons are not as bad as you may think. I hope the kid learns from the mistake. Prison will only make him more likely to engage in other criminal activity.

No, I know a lot of people who did really stupid things in vehicles, including driving way over the speed limit, but never got caught or had anything tragic happen. I know one person who did end up killing someone. Sorry if you found my post confusing.

It wasn't confusing it's what you said. Other than that i am not innocent on doing stupid things while driving.

Sorry, I'll try to be much more specific in my phrasing just for the nit pickers on the board in the future.
 
Weed stays in your system for a long time. Especially if you use it regularly. Probably not hard to make a scientific case that those levels could be present in the blood stream without a person being impaired at the time they were driving.
Sounds like with initial indictment being dismissed they may be laying a case for complete dismissal? Best attorneys money can buy? If the kid is a 4 star recruit and driving a late model Challenger, there is money involved.

Is there going to be no accountability here? How is being high vs drunk really matter? And what does it matter if he wasn't high at the time (weed stays in systen a long time)? He was still going 88 in a 35 and killed someone.

I agree he should get some serious charges for killing someone going 88 in 35, if he was actually going that fast. I don't agree that anyone with weed in their system should automatically get a DUI when it can last in your system for up to a month after you have had any. Also, a 2016 charger indicates money is involved? That in no way indicates there is enough money for high powered attorneys. Besides, I'm pretty sure criminal suspects don't have attorneys present in a grand jury, but someone with more knowledge in law can correct me on that. Like the article says if a grand jury doesn't want to bring an indictment the evidence in the case must be very flimsy.
