Barta didn't get to decide nothing. Those decisions for such a lawsuit would be coming down from above him.

I really don’t have much issue with the ID. Deserves a fine but not much more.

But we really need to treat OWI more seriously in this country. I’ve seen a lot of comments about it being not a big deal because no one got hurt. That attitude is why this keeps happening. Waiting until someone is hurt or killed to punish people for poor actions is ridiculous. If you shoot at someone but miss them, do you get a pass because you didn’t hurt anyone?
I don't have a problem with the fake ID as long as he didn't try to present it to the police and they just found it after the fact. Using it to get into a bar vs presenting it to law enforcement are vastly different.

No one is immune to it. I got one when I was 19 and only blew a .04. I was pulled over because 'I didn't come to a complete stop' which was ********. It was 2:00 am in a small town. Literally no one on the roads and this was a rookie cop looking for something to do. I passed the FST but zero tolerance had come into effect that year. Doesn't mean I should have been driving but by every indication besides age I was doing nothing illegal. Not every DUI is some drunk puke being brazen.

Were you wearing ISU apparel? Cop probably busted you just for that (if you were in Eastern Iowa anyway). ISU apparel = thug at Thug U.

Nope. The really stupid part was my two friends with me were drunk AF. So if we're really concerned about under age drinking we all should have faced consequences. I was actually released by the officer but only when her superior officer monitoring her mentioned that I wasn't 21 did I face consequence. Just a stupid situation all around.

Nobody got hurt I assume? Don't really care otherwise. People do stupid things. Some learn from them and some don't.
Not sure how you disagree with this. It's stupid. People do stupid things every day and thank god nobody got hurt.

So, college kids who get their first OWI should have what happen to them? Prison? Lose their license for life? Labor camps?

There should be levels that would necessitate some jail time. If youre driving over a level like 0.15, then yes jail time is warranted due to the reckless endangerment of others. There should be a distinction between buzzed and extreme intoxication. A year suspension of your license isn’t out of line for all offenses IMO.

But this isn’t limited to college kids. There are plenty of adults that show a disregard to drunk driving as well.

Kind of ridiculous to expect someone who's intoxicated to know their BA content. I don't even drink that often and I got a DUI 20 years ago. It can happen to anyone.

Isn't that what already happens? I always thought you went to jail (at least overnight) if you were charged with a DUI. Don't you lose your license for a while as well? Doesn't the punishment get worse after the first offense?

It in fact cannot happen to anyone. Some people are responsible enough to find a ride when they are drinking. Some are not.
