    Texting while driving: The law is not working

    I'm still seeing tons of people texting while driving (virtually all of them women). I think I'm seeing more now than before the ban went into effect. I think they need to make it a primary violation (so they can pull you over for that and nothing else) or the law is going to have no effect.

    OK, rant time. What is it about women that they HAVE to be on the phone while driving? My wife does it all the time. The second she starts driving, it's time to talk to her sister, mom, etc. It's not just my wife but it's been my experience with most women. I've asked friends about it as well and nearly all of them say the same thing.


    While on live TV, Ford used a vulgar term to describe a private part of the female anatomy, adding that he was “happily married” and “got more than enough to eat at home.”

    Exactly. This law cannot reasonably be enforced by police officers. Just not practical.

    Hard to enforce, what if you open your phone to pick up a call or are trying to find a contact to dial? Unless a cop is driving right next to someone that is obviously texting or sitting at a stop where it is occuring it's hard to enforce. I think it's mostly another thing that they can ticket someone for when they pull them over for something and observe it.

    Also, how do they prove it unless they check your texts at the time they are trying to cite you, is there any privacy law that would require a warrant for them to do that possibly? I'm curious just how many citations have been given on this new law so far.

    I see it a lot too, maybe I'm just noticing it more. To a certain extent it's an unenforceable law. As you mentioned, its not a primary violation, and while they have the resources available to look at your phone records, it seems like the resources required wouldn't be offset by the citation. Akin to going to court over a $5 parking ticket.

    Right now it seems like it will most often be cited retroactively following an accident.

    I may be totally off on this, but isn't the law only enforced on drivers 19 and younger? I thought I had read it that the only way to get a ticket is if you are pulled over for another violation and they can prove that the violation was caused by you being on your phone - did I not read this right?

    I agree, very tough to enforce but I think that in most cases the cops can tell if someone is messing with their phone its just being abel to prove that they were texting and not looking for a phone number etc.

    If I see a woman and she is driving an SUV, you can pretty much be certain she is also talking on a cell phone.

    Over here on the west side it is pretty much a given.

    I was under the impression that law enforcement agencies are able to access cell phone records without a warrant, because they are wireless - only landline phones need a warrant. Hence, why Tony Soprano always talks business from his home phone and pay phones.
