    If someone uses your credit card without your permission

    Weíve been talking about Simsí situation and everyone has different opinion re: the appropriate punishment for him based on the severity of the crime. I realize that there are still missing link in the story (e.g whether the card was actually stolen, it was awfully quick to identify Sims).
    But I want to hear your opinion if you experience the similar situation (hopefully not): someone uses your credit card without your permission and then gets caught. Letís assume heís not an athlete, not a Cyclone or a Hawk. Just someone you donít know. What kind of punishment you want this person to get ?

    I want them to repay me and pay a fine, but I don't think they should serve jail time or anything. It's not a violent crime.
    There's people out there floating thousands of dollars of bad checks that are basically stealing from businesses and people, but that seems to be OK with the world.

    I was in college and my wallet got lifted at the rec. My card was used by a football team member, I wanted to press charges but it was all swept under the rug.

    I want to be reimbursed for whatever charges they ran up along with whatever possible charges come from my credit card company/bank. Then they should receive whatever punishment they receive from the judicial system. Obviously if they are repeat offenders they need to receive punishments that they increase every time they offend. I work with kids who have committed crimes and when they ask why they steal they often tell me that I am the one whose dumb for paying for it. I can only imagine what my parents would have done to me if I had said something as ignorant as that.

    This. Restitution and a fine is really all that needs to be done in a case like this. It isn't like the offender deserves the electric chair like some of the people on here think.

    What about if they don't have money to pay the fine, or pay you back?

    Maybe not jail (depending on the amount), but it tells me something about the character of the person, be it an athlete or a regular person. It's a lot more than "stupid" or "reckless" (terms I've seen used on the threads about this). The trust is gone, the damage is done.

    I would press charges and i would want them to pay me back, then i would let the court go from there.

    People aren't looked upon as criminals when they overdraw their bank account or write a bad check. That's what I meant.

    Once, a friend of my brother, stole a personal check and forged my brother's name. My brother caught it. Called up the guy's brother in law. And they confronted him. He repaid the amount for the check. And my brother didn't involve the law. He could have ruined the guy's life. The guy said he was desperate. The guy was very lucky. He is lucky my brother is a compassionate guy.

    If a person had a clean history previously and made restitution, I would be willing to forgive them and not press charges if they used my card.........the first time. If it happened again..............Book 'em Dan-O.

    I think the punishments in place by the courts are reasonable. A fine that is at least equal to the amount of damages + punitive fine or jail time if they are not able to pay. CPR is free to add any additional team-related punishment for disrespecting the Cyclone uniform.

    Pay the money back, pay a fine, and be on probation for a set period. There isn't a need to jail them but it should appear on their record. It shows poor character and a lack of judgement.

    Agree. BIG waste of taxpayer money to throw them in jail.

    But knowing our court system we would jail him. And let the multi-million dollar embezzler go. While letting him keep a few million for his efforts.
