    Who owns the engagement ring?

    People are increasingly suing to get engagement rings back after the breakup.

    Is an engagement ring a gift?

    Is an engagment ring conditional given to a partner?

    According to the linked article, there is not a legal consensus on this issue.

    In Iowa the caselaw is clear that it is a conditional gift based on a promise. That condition is not fulfilled until the marriage occurs.

    Iowa also has the "no fault" rule as well. Doesn't matter who's at fault for the break-up, the ring goes back to the person who purchased it.

    If she breaks up with you, that is breaking an agreement, therefore the ring is yours. If you get married, she gets to keep it. Talk about double jeopardy.

    Being married and having ups and downs in a relationship and seeing others get divorce here are my tips:

    1) If you have any doubts don't say "yes". Don't feel too bad if he already bought the ring. It's easy to return an engagement ring at a store (most likely he bought it on credit that he can't really afford, so you might being doing him a favor)
    2) Don't ask unless you're sure. Don't do it to "save" the relationship. Most likely there are deeper issues and the marriage will just postpone those until sometime during the marriage, leading to divorce
    3) If at the time you're sure and they are sure and you end up breaking up, it's her ring. It's a gift and she can do whatever with it. Don't be more of a d-bag and try to get it back. If she wants to give it back to you, she will.

    and I disagree with that. Its a gift... the person who receives it as a gift may do with it as they please.

    I always thought if she breaks it off, it is his, but if he does it is her's. If she does something stupid like hook up with a guy at the Metrodome, then it is his again. The whole discussion is a gray area. If he does break it off, the nice thing to do would be return it, but I don't know that she would be obligated.

    Hope I never have to worry about this. I'd think if the female broke it off or caused something that led to the breakup it's the guy's to have back. If the guy did something say cheated on her or decided to break it off then he in a sense did not live up to his promise and I see the ring then compensation for the money and pain the guy put her through. Like right now, my fiance are planning a wedding and her or her family has already made deposits or down payments on the reception hall, DJ, food, etc. which would be non-refundable if the wedding were not to happen. In the case the guy was the reason behind the wedding not happening I can see how they might want to keep the ring.

    Touchy subject and so many scenarios that could happen to make you think 1 or the other deserves the ring.
