    Civilian court trying ex-soldier for manslaughter

    Jose Luis Nazario was a Marine Corps sergeant in Iraq. He left the Marines in 2005 with an honorable discharge and a medal of valor.

    Now he is standing trial in a civilian court for crimes said to have occurred when he was a soldier in Iraq.

    theres a guy here in iowa they are trying to charge with war crimes. i belive he is from afton iowa

    An update to this story is that two Marines that formerly served with their former squad leader have refused to testify and therefore are being scheduled for a court martial.

    That article is so poorly written that it is difficult to tell the facts of the matter.

    It's initial claim that the military cannot prosecute the Marine (not soldier. A Marine is a Marine, not a soldier. The ARMY has soldiers) because he has been discharged is categorically false.

    All former members of the military can be recalled to active duty in order to be a prosecuted under UCMJ, or to be a witness in a UCMJ proceeding. Evidently, the military has declined to do so in this case.

    The bit about the witnesses being UCMJ'd for refusing to testify is just cryptic and confusing. I'd like to see what the facts are in this matter before commenting.
