    Man sues over mattress purchase

    Before buying, Dickstein said, he tried out three mattresses at the American TV & Appliance store in Brown Deer in May 2006 and selected a Stearns & Foster mattress that was supposed to provide the greatest support. He shelled out $1,400, and the mattress and box spring were delivered to his Fox Point home the next day.

    He said he called American the next day, complaining that the mattress was clearly defective. A technician was sent to Dickstein's home. The technician inspected the mattress and found the indentation in the middle of the mattress to be 1 1/4 inch with no one on it. That fell within the manufacturer's specifications, Dickstein said he was told.

    He demanded his money back, citing a 10-year guarantee. American declined. The store offered him another mattress, but he rejected the idea, saying he had gotten what the store purported to be the firmest mattress.

    The store refused to give him his cash back, he said, saying he had signed a contract accepting the mattress.

    He said he had been misled into believing the document he was signing was just a formality, not a contract.

    The jury didn't buy it. After deliberating just minutes, they returned a verdict that said American did nothing wrong.

    Dickstein said he's not giving up.

    "I'll take this to the Supreme Court if I have to," he said. "They'll have to pay their lawyers five times as much as I paid for the mattress."

    $7000? That's practically nothing.

    Didn't he lay in the mattress before he bought it? If he did and he liked how it felt what does it matter if it's 1 1/4 inches or a 1/2 inch or whatever.

    I know a guy who hounded an auto dealership for a year until they took a pickup truck back. Evidently, his 2005 Dodge Ram was 1/2 inch lower on one side as measured from the rear bumper, than the other. This bothered him, immensely, and the dealership attempted to fix the problem (how????).

    The dealership's corrections would often throw the vehicle off the other way by 1/2 inch or so. Sometimes, the customer is NOT right. Sometimes, they are just a tool.
