    $54 Million Laptop Lawsuit

    In 2006, Raelynn Campbell bought a new laptop from Best Buy for about $1,100. The clerk pitched her a $300 extended warranty. She agreed. The machine’s on/off switch broke a year later. She brought it back, relieved she’d purchased the warranty. Best Buy told her repairs would take 2 to 6 weeks. But the repairs never happened. After weeks of back-and-forthing, Best Buy finally admitted they lost her laptop, which contained, she alleges, thousands of dollars worth of music and thousands of irreplaceable photos, as well as personal information such as tax returns. Best Buy’s best offer of a $1,100 refund and $500 store credit apparently didn’t alleviate Campbell’s pain.

    So in November Campbell filed a suit pro se in Wash., D.C., Superior Court — for $54 million. Best Buy came back offering $2,500, in addition to the refund and store credit, but Campbell said no.

    Actually - I think it's a great lawsuit and she has the perfect attitude.

    She freely admits that why she picked the amount and why she's going about it, and that she doesn't realistically expect to win near that much. It would appear completely accurate that this is what it took Best Buy to pay attention.

    I hope she gets a decent amount of money. Certainly not in the millions, but well into the thousands and her costs.

    Edit: There's a "Red Tape Chronicals" report on MSNBC.com that interviews her, tried to interview the store manager of that Best Buy, and goes into much better detail of her experience. This CBS report makes it come off as much more frivilous than it otherwise seems.

    I usually have a thing against frivolous lawsuits, but reading about how she got dicked over on this one, well, to quote "The Boondock Saints," "I'm strangely comfortable with it..."

    I'm never buying a computer from Best Buy again... granted, there is nothing wrong with my HP that I bought a couple of years ago... but it was overpriced and I bought the 3 year extended warranty.... we'll see if something happens within the next year or so how well they treat me with service.

    I do need some work done on my DVD drive.... hmmm.

    BTW - I hate overpriced lawsuits. She could have sued for 1 million and had the same effect, IMO. I would definitely try to get a good chunk of change, but come on, anything more than $200,000 is way too much. Personal pictures and music or not. That much money will buy you some new memories....

    I say go for it... Best Buy has been playing games with my brother in a similar situation... His power chord went bad on at top of the line computer he bought there a year ago, they claim they cant find a match and he is SOL, even though he has a warranty. They offered to replace it with a MUCH lower end model. They are still holding his computer. Not only does it have ALL his personal info but scouting videos of almost ever MLB player.

    When I saw the thread title, my brain for like half a second said to itself "$54 million laptop?" My common sense quickly jutted in and said "No, not the laptop - the lawsuit you idiot.) But it got me thinking...how amazing could a $54 million laptop REALLY be?

    If she had all that valuable information on the laptop shouldn't she have backed it up? Or shouldn't Best Buy have asked her whether she had valuable information on the computer and reminded her to back it up?

    Hmm...my ex had a really similar problem with the power cord going out after about 9 months and Best Buy saying they couldn't get another so instead gave her a cheap replacement that works about 1/2 the speed of the other. I never buy anything from Best Buy (or any big box retailer) because it's always cheaper on the internet.

    Back on topic, I think 54 mil is more than a little excessive, mostly because it's sets a precedent that is patently ridiculous. I wish people would sue for the amount they actually expect to win and they would get that much, not he exponentially higher figures they pull out of the air. Hope she wins though. Their warranties are BS - I don't trust any except from the manufacturer.

    Just bought a Samsung 40" 1080p LCD HDTV from Best Buy this evening for a $1350 "open box" special (yeah, I know - I probably could have done better on the internet - screw it). Decided not to buy the warranty for it. Considering the horror stories I've been hearing about how Best Buy actually does their warranties I'm glad I didn't pay the extra $180 for their "service"...

    If you read the other article - it seems pretty obvious she just pulled the number out of thin air - actually she intentionally picked the same number as that NYC judge who sued his cleaners.

    I don't think this will ever see a court room and she knows it. She admitted she did it just for the media attention and negative publicity on BB to get them off ther arses and take her seriously. In the other article, it lays out better timelines, that she made more than a few calls and it took weeks/months before they admitted the lost it. In that time, she had personal info that was at risk and is now paying for credit monitoring. And their initial compensation was only a few hundred in gift cards - not enough to cover the cost of the laptop they lost, and as if anyone would want to buy something there anyway. Her initial demand was for only $2100 in cash - so she could shop elsewhere. They never responded.
