    Rental Property Damage

    I am currently renting a house that is 10 years old. The carpet in the house is 10 years old as well. It is very cheap and has a lot of wear and tear. A few months back my dog ripped up a corner where it meets the tile. There is no tacking strip where the carpet meets the tile at the entrance. There is about a square yard of it that is damaged and it is all tattered. I can't just put replacement padding down and lay the carpet over it due to small part of the carpet actually missing. A new 1 x 1 square might have to be installed. (See photo)

    My question is how do I go about it with the landlord when I move out in three months. Do I fix the issue myself and never tell the landlord or do I try to swing the idea that the whole carpet just needs to be replaced because how worn it is and there is no bother for me to clean or repair it?Click image for larger version.

    I would assume the landlord required a larger deposit, part of which was nonrefundable due to having a dog? If so, I would assume he will fix it using that nonrefundable deposit. Just don't say anything about it and question it if he does not return your refundable portion of the deposit.

    The deposit for the house was $900 with an additional $100 for a pet.

    I would casually ask the landlord if they are going to replace the carpet when you move out or at least think about it. Then tell them about the problem, but leave the part out about the dog. If the landlord was going to replace the carpet then it really isn't a problem.

    I would contact your landlord as soon as possible, and just let them know that the carpet started to rip (assuming) from normal wear and tear. And then your dog finished the job. Hopefully you're allowed to have dogs in the house. If you're proactive about it you might be fine, but if you wait until you move out it might be tougher to believe.

    When you rented the house, did you do a walk through the house and identified any issues that were existing? For example, if there was a cracked window, anything broken/missing from the previous tenant, that you wouldn't be responsible for when you moved out? If this was an issue, and it was noted on the original walk though you may be able to get out of it. If it wasn't you are going to pay for it.

    If you don't say anything and move out without telling the landlord, he will find it if he does an inspection after you move out. He would most likely take the amount to repair it from your security deposit. As for fixing it, how are you going to do this? If you replace the section with new carpet, it will standout like a sore thumb.

    I would contact the landlord as soon as possible and let him know what happened. It's not like you were trying to hide the fact that you had a dog because you paid extra security deposit. Be upfront with him, and work with him on a solution rather than trying to sneak something by him.

    And then document everything.

    You'll probably still lose your entire deposit.

    You could tell him as you were walking through the hallway, the seam in the carpet had come loose and you tripped and fell. It is a safety hazard and they should repair/replace immediately.

    Check the state laws. In Indiana, renters are required to replace the carpet every five years. When I moved out after 7 years, they tried to charge me, but I was lucky enough to have known someone in the business to tell me that little known law and they refunded me the amount for my damaged carpet.

    Unfortunately i wouldn't be surprised if the landlord replaces the carpet after you move out, even if he wasn't planning too before. And it's gonna be on your dime.

    But, I agree with everyone saying document EVERYTHING. Having pictures got us out of a hairy situation when we moved from Waterloo to CR (ie. landlord was gonna screw us until I mentioned having pictures with time stamps I could show them and my lawyer if he would like) Next thing we know we had our entire deposit back and never heard another word.

    As a tenant, we lost to many deposits.
    As a Landlord we have seen good tenants and bad ones.
    Bottom line, contact the Landlord first and be honest.
    Regardless of the end point, you have done the right thing.
    Just my thoughts.

    Do you have any pieces of tile that you can replace the torn piece of carpet?

    The IRS gives the life expectancy of carpet, drapes, appliances, etc 10 years. I think it works that if you had moved in and the carpet was new, moved out after five years, you would be expected to have 50% of the cost of new carpet deducted from your deposit.
