    This is again why I think its stupid to give people public intox when they could be doing something a lot worse like getting behind the wheel of a car.

    It depends on what they are doing. But yes lots of people get a public intox because they decided to walk home instead of driving. Every situation is different I think.

    Reminds me of Leonard Little from the Rams. He drove drunk and killed someone and then got busted for drunk driving AGAIN a couple of years later. As far as I know he never did any jail time. I just have no tolerance for drunk driving.

    I don't think it has anything to do with what they are doing. If they are doing something ELSE illegal, like an assault, or trespassing, or disturbing the peace, or some sort of vandalism, or public urination, or one of the other various things that draws cops in the first place, then charge them with that. Don't just charge them with being drunk in public.

    On top of that, there is no standard for public intox. i.e. it's entirely a judgment call on behalf of the arresting officer. There's no "legal limit" for public intox. One beer, walk across the street and you can be arrested for public intox.

    It's the stupidest enforced law I can think of.

    PI.....I was lucky enough to get 2 while i went to ISU. The first I was was leaveing the Dean's List on fell down and was slow to get up they said on the police report. It also said asked him to do his ABC's and he(me) sang ABC 123. The second was the same officer while I was in Dean's List. I asked him a question and he said youre drunk again. Of course I am, Im in a bar at college. The first one I was hammered the second just buzzed. How the Heck to you ge a PI in a bar. Tell me who isn't intoxicated in a bar
