    Legal Advice

    My fiance and I booked our wedding reception venue a few months ago with the Hotel Pattee in Perry. We were planning on holding the reception in September 2014. The other day the hotel closed their doors out of the blue and according to the news, are not giving any refunds. We payed to reserve the banquet room ($500). Do I have a legal leg to stand on to get this money back?

    I believe so. You essentially paid a deposit which is conditional on the room being available. Since it's not available that deposit should be returned to you.

    Now whether your legal/court fees would be under $500 is another question entirely. My guess is no.

    You could try but I honestly don't think you have a chance to get the deposit back. If I remember correctly from when my wife and I got married, reception places have stated in the contract that you sign to reserve the place what would happen if the place closed, there was an "act of God", or such. Those state that you don't get a refund. I would look at anything you have signed for that info.

    We didn't sign a contract yet, but we did get a receipt saying that we paid for the room.

    you may be up a creek then. Every wedding vendor we worked with signed the contract at the same time we paid a deposit. That would seem fishy to me that they wouldn't have done that for you at the time. Can always try going to media about it - not like they're worried about business at this point, but can always try shaming them into doing the right thing and returning the money.

    You've certainly got a claim against somebody, probably Hotel Pattee LLC or possibly Leisure Hotels. Collecting on that might be a challenge though, especially if the LLC is liquidated (because you're just another unsecured creditor).

    Did you pay with a credit card?

    I remember a story of a despised water softener salesman who ticked off a lot of customers with his sales schemes. One customer stole his van, drove it into a cornfield, and started it on fire.
