Re: White House ordered to preserve all e-mail

I thought the preservation of pretty much all government documents was already mandated by the Federal Records Act? It seems strange that a special court order is needed.

It's meant for the headlines it brings with it. Honestly, with the sad state of our internal security, I'm not sure if it's better if we keep them or if we don't.

Re: White House ordered to preserve all e-mail

It's needed because the Bush Administration doesn't think the rules and laws apply to them

They have used RNC email servers since day 1, in direct violation of the Hatch Act, and then the emails go "missing".

the article also says that the White House stopped preserving emails in 2003 because they say there are "backup tapes" that have all the information. the judge said that wasn't good enough.

About a year ago, the courts decided on some new e-discovery rules that basically agree with this - What is electronic discovery? - a definition from Whatis.com - see also: EDD, ediscovery, e-discovery, Legal Discovery, Digital Evidence, Content Discovery, Digital Discovery, Electronic Evidence, Electronic-discovery, Email Discoverability, e-Mail D

This applies to everyone who operates an e-mail server that could be called upon during a discovery process.

Public companies have to do this for SOX compliance, why not the fed government?

That's really a simple answer: the Bush White House doesn't think the rules apply to them.

So you've said and it must therefore be true.

It would be nice to see them fight this and break some of these discovery requirements. I happened to come across and e-mail advertising a class on e-discovery last spring - in it they were talking about that not being limited to e-mail, but extending to every bit and byte in all companies in the US. Not only must everything be available, but it must be properly archived and catalogued.

    Yuck.
