    Parental Permission, Privacy Rights, & Abortion

    The Alaska Supreme Court overturned the state law which had previously required parental consent for a child to have an abortion. This is headline news up here. Any thoughts?

    Other than my opinion that substantive due process is a big crock of BS forced upon the American people by the intellengentsia, not really.

    Social rights questions not addressed by the US Constitution should be handled by the states individually according to political principles or, alternatively, by the Federal Government according to politcal principles when it falls within the enumerated powers.

    I find it ironic that a child has to have parental permission to get an aspirin from the school nurse, and parental permission to receive virtually any other kind of medical treatment, but when it comes to abortion parents get no say in what does or doesn't happen to their child

    I just want to ensure that when you're using the term "child" you mean under the age of 18, and not just "still in high school."

    If it's the former, that's a load of crap in a crap bucket. I boo the courts in their decision.

    The Alaska governor, Sarah Pahlin considers it "to be outrageous that a minor girl can get an abortion withoutparental consent." The law that was overturned had required girls of age 16 or younger to obtain parental consent before getting an abortion.

    Yea, that's a bunch of crap. If you're worried your parents will find out your pregnant (or your girlfriend for that matter), you shouldn't be having sex. Well, they shouldn't be having sex in the first place, but that's a semi-different matter altogether.

    I think parents have to be notified, and it's ridiculous if they are not. The post-abortion problems are numerous, and a young person should have someone who actually cares about them inform them of the consequences, especially the potential depression later in life.

    There is no legal requirement in Alaska that the parents be notified. The state legislature is in the process of passing new legislation which would require notification. However, whether notification is constitutional is not clear. It will require another court case to resolve that issue.

    The reasoning of the Alaska Supreme Court follows....

    ...[W]e ultimately conclude that the Act does not strike the proper constitutional balance between the State’s compelling interests and a minor’s fundamental right to privacy. [...]

    The State's asserted interest in protecting a minor from her own immaturity by encouraging parental involvement in her decision-making process is undoubtedly compelling. But by prohibiting a minor from obtaining an abortion without parental consent, the Act effectively shifts that minor's fundamental right to choose if and when to have a child from the minor to her parents.

    Usually a statute must include some sort of bypass provision (usually through a court proceeding) that would allow a minor to get an abortion absent parental consent.

    Without arguing either way, I do think the decision to have an abortion is significantly different than most decisions of a minor that would require parental permission in that the potential parent is likely going to be exposed to the consequences of that decision for a very significant time afterwards.

    Alaska had in a prior case determined that bypass provisions unconstitutionally burdened the right of the pregnant minor to seek an abortion.

    IMO,the state should not recognize a "right of privacy" outside of the 4th amendment. Such a "right" should only be recognized upon constitutional amendment.

    Here are some other rights that should only be recognized upon amendment:

    family planning
    health care
    right to marry.

    What "minor's fundamental right to privacy" are those filthy old lawyers in black robes talking about?

    What was the ruling where the court decided it had the right to make law?
