    Union files collusion lawsuit against NFL

    The NFL Players Association filed a lawsuit Wednesday that accused NFL owners and the league of collusion during the 2010 season.
    The complaint describes a conspiracy in which teams imposed a secret $123 million per-club salary cap for that uncapped 2010 season. Filed in in the United States District Court of Minnesota, it alleges that the league and owners “acted illegally and solely by self-interest.”
    “When the rules are broken in a way that hurts the game, we have an obligation to act. We cannot stand by when we now know that the owners conspired to collude,” NFLPA Executive Director DeMaurice Smith said in a statement.
    Added NFLPA President Domonique Foxworth: “Our union recently learned that there was a secret salary cap agreement in an uncapped year. The complaint today is our effort to fulfill our duty to every NFL player. They deserve to know, above all, the facts and the truth about this conspiracy.”
    New York Giants owner John Mara, who also serves as the Chair of the NFL Management Council Executive Committee, is cited in the complaint as publicly confirming that the league told teams to restrict players' salaries in the uncapped year.
    In response to the complaint, NFL spokesman Greg Aiello said: “The filing of these claims is prohibited by the Collective Bargaining Agreement and separately, by an agreement signed by the players' attorneys last August. The claims have absolutely no merit and we fully expect them to be dismissed.

    I'm interested to hear how this plays out. It does seem odd that Dallas and Washington can be penalized for salary cap violations that occurred in what was supposed to be an uncapped year.

    That, in itself, ought to be explained.

    It's interesting, but it's hard to feel sympathy for either side when you're talking about limiting salaries for a group of 53 players to a pool of $123 million. (an average of $2,320,754 per player)

    Regardless of the dollar amount, it does seem shady that someone could be penalized based on a salary cap that supposedly didn't exist.

    So much misinformation.

    1) The Cowboys and Redskins are not being penalized for spending too much, or paying any players too much. They're not even being penalized for front loading contracts, which several other teams did as well (see Julius Peppers). What they're being penalized for is taking dead money from deals signed prior to 2010 and dumping it (from an accounting standpoint) into the uncapped year. The "collusion" to hold salaries down during the uncapped year did not exist. This was an agreement on cap accounting techniques so as not to take advantage of the gap created during the negotiation of a new CBA.

    2) Saying that Cowboys and Redskins fans are now paying full price for a watered down product is not true. The penalties were to level the playing field and remove the benefits the two teams gained via shady accounting practices. The money from old contracts that they dumped should still count against the cap, the same way all other teams' dead money from prior contracts still counts against their cap. So instead of playing with a cap room advantage over the other teams, their effective cap room is now the same.

    3) Please stop asking why teams that underspent were not penalized as well. Underspending has been going on for years and it does NOT provide any sort of competitive advantage. Cap dollars are "use them or lose them". Unspent money does NOT carry forward into the new year.

    It's still stupid. All it was was a verbal agreement, so what if they were smarter than everyone else and used a loophole? Everyone else is just ****** off at them because they didn't do it themselves.

    Also, anyone thinking that they have received an unfair advantage clearly hasn't seen either team play...

    By breaking an agreement made amongst the owners. Agreements don't have to be "written" or part of some contract in order to be legally binding. Verbal agreements are legally binding. The issue is whether they can be enforced by showing convincing evidence as to what agreement was made.

    If Jones and Snyder really thought they had a legitmate case, they could take this to a court of law. I would speculate that the other 30 owners testifying in front of a judge as to what was agreed to would be sufficiently convincing to a judge.
