    Legally? I never really thought about it I guess.

    Automatic gratuity for a party of 5 is ridiculous in and of itself, I could see a large party, say 8 or 9 people maybe.

    agreed. The fact that it's become customary is the bad part. I wonder what would happen if a store like HyVee posted a sign outside that said "15% gratuity added for all purchases of greater than $100." How long would that last?

    It's illegal to not pay the $9.99 for the burger, just like if it says you have to pay the 17% and you don't. It's part of the bill, part of what you are buying.

    In the end, the family ended up paying the 17 percent gratuity because they wanted to avoid any further problems.

    Yup, exactly. But it does go both ways. Regulars at bars sometimes think they can leave tabs and pay next time they come in. Can you do that at HyVee? So it's a headache going the other way, too. And then they fail to tip when they come back and pay most of the time. Annoying.

    I work at a restaurant where there's no automatic gratuity. 15% on over $100 would be nice. I hate the feeling of busting my *** (flawless service) for a large amount of people only to be left with nothing.

    8 out of 10 people who have bad restaurant experiences correct immediately will come back.

    A person is likely to tell 7 people about a bad experience at a restaurant.

    You can't force someone to pay a gratuity. I'm sure that's exactly what it's called in that restaurant's policy, too. Call it a surcharge and you can make it mandatory.

    But if they call it a gratuity, you don't have to pay it.

    I don't care what you call it, it doesn't matter. If it states it will be added and that you have to pay it, you can call it whatever you want - but you are gonna have to pay it.

    That's not necessarily true. I had a friend that paid cash on a check once that had gratuity added. His check was like $23 something and he gave the waiter $22 just to mess with him. The waiter saw it, but didn't do anything about it. He was kind of ******, but didn't say anything to my friend about not paying to whole bill.

    (yes, he made good on the bill before anyone goes off on my friend.)
