    Anyone ever get an incorrect W-2 that the employer won't fix?

    My wife's company was merged with another company last June. So even though she didn't change jobs, she got two W-2s for the year. Which might make sense if one W-2 was from the old company and the second W-2 was from the merged company. But both W-2s are from the same company - same name, federal EIN, everything. Why they sent two is beyond me.

    Anyway, it quickly became clear that they overstated her income. The taxes and withholdings are correct but the income is high. I isolated the mistake to the first W-2. She pursued it with her company but they insist it's correct.

    After some research I learned that you can pursue this with the IRS and they will take it up with the employer, and if it still isn't corrected you can file a Form 4852. The downside there is that you have to file by paper and possibly file a 1040X once things are properly corrected. But worst case scenario it does seem we have some recourse here.

    So I have a couple of questions: First, if this drags out, would I be better off filing for an extension, hoping things get straightened out, and filing my taxes once correctly rather than having to risk re-doing them? And second, is there anything else I should be thinking about or looking into?

    I'm not an accountant but I've done my own taxes for years and this is a pretty obvious error. And it's worth a few hundred dollars on our taxes. Any advice or insight is appreciated.

    I started using an accountant for my taxes a while back, after the IRS said I screwed up. Its paid for itself in spades. My advice, should you choose to accept it, is hire a professional (I'll recommend Travis Sisson, CPA in WDM, 453-8502) and let them get this mess straightened out.

    I've never had to file for an extension before, but my Grandma runs a HR Block and it sounds pretty easy to get an extension. Just make sure you start the process with plenty of time before your taxes are due.

    Can't help with much else.

    How big is the mistake on the W-2? I think that would dictate, to a certain degree the course of action you take.

    Zing! As I told my wife, if they wanted to pay her the extra money her W-2 says they paid her, we'll call it good on the spot. Alas, I don't think those funds are forthcoming.

    what do you have in terms of documentation that shows she was not paid what is on the w-2?

    Depending on the bracket it could be several hundred.

    It seems that you have had some good advice by getting a professional, but it is really easy to file for an extension. The only thing is if you usually owe you will have to have to estimate your taxes and pay in based on the estimate. I am not sure of the threshold but if you are way off you will have to fees/penalties if you owe more money. I would get a professional if this is your case as they can help you through the process.

    If you usually receive a refund the process is a lot easier as then you won't have to pay. Keep in mind if you do extend you get another 6 months to figure it out. If it still isn't resolved you can always go the route of amending your return.

    I overstated my income by 7k one year and just said screw it. Better than hassle with the IRS. Few hundred bucks isn't worth it, but to each their own.

    Yeah I guess a $2k would only amount to a few hundred which might not be worth the hastle, but $7k in one year would be close if not more than a $1k in additional taxes. I guess I should thank you for you donation.
