    Lawyer Question: Could this be a class action suit?

    Hey guys, fair warning this'll be kind of long.

    Back in 2003 my dad bought a Chevy Impala. This car had an "internal" antena built into the rear windshield, and the excellent sound system was a heavily advertised feature in the car's literature (this is an important point later). After a few weeks he started to notice that when listening to the radio electronic components of the car would cause interference. When he pressed the brakes, rolled down the windows or even turned the wheel, he'd hear occasional "pops" on the radio.

    He took it to the shop and told them to fix it. They tried like the dickens to fix the problem but eventually after 3 or 4 trips into the shop (Note: the car was still under warranty) they couldn't fix it. M dad, being the PO'd old-school mofo he can be when he wants to, called the attorney general. Long story short: class action lawsuit came about under the lemon-law and my dad, and several other people, got a nice cash settlement. According to the AG, this was only possible because the quality of the sound had been touted as exceptional, and was a big selling point of the car.

    I pay $60 a year for a new version of NCAA Football. Usually I buy it because something they've added, and advertised heavily, catches my interest and I can't say no.

    This year it was custom playbooks which never quite worked and have been patched to work even worse. NCAA 12 has all sorts of broken features, but most of it is gameplay stuff (like the ball hitting receivers in the head) but custom playbooks were a big selling point of the game.

    Is there a class-action lawsuit here? Where is the legal line drawn between cars and video games? What legal checks, if any, are in place to protect consumers from a game that is advertised one way but actually doesn't work? EA has my money already, so why should they bother fixing the feature?

    I hope this doesn't portray me as whiny or as a typical sue-away-my-problem American. I'm very curious and legitimately interested in how this works than anything else.

    TLDR; EA's games frequently suck and sometimes border on a "lemon." What checks are in place to protect consumers something advertised one way that doesn't work?

    I won't go into the lawsuit part of it, as I am rather biased in that regard, but my brother in law and his friends play the online portion of this game religiously, and it evidently locked up and locked them out of their league soon after getting the game. They can't restart one. He said they've been promising to patch it, but still have not. That's just **** poor in my opinion.

    Yes I got into and graduated from ISU and it doesn't have a law school so how should I know?

    But seriously OP, pick up an Iowa Code of Law book and read through some of it.

    I'm legitimately confused why a broken/poorly designed feature on a car that millions of people bought is different from software that millions bought.

    Also, to further clarify, I WAS ASKING. It's not like I was going to go make an issue of it. My God, the internet is a rough place even among "friends."

    This is the type of attitude that makes it BARELY worth it to be in business anymore in this country. I have no respect for you frankly.

    Avoidance of litigation and legal representation eat up such an enormous amount of time and money, that it's almost unimaginable. Frankly, companies could hire more people and reinvest in better products/service if they weren't drained by DB's such as the OP.
