    Traffic Citation

    Over the weekend I was in a minor car accident. Minimal damage to all vehicles in the accident. However, I was cited with "Failure to stop in an assured clear distance". The officer stated it was a minor citation but I will have to go to court as there is no scheduled fee associated with the citation. The officer said I just need to go plead my case to the judge and hope that he/she is in a good mood. Anyone ever have any exerience with something similar to this? What should I expect?

    I had one almost 20 years ago. The guy in front of me stopped short to turn into an alley. When his brake lights came on I thought he was braking for hte red light about 50 yds ahead of him. it was too late by the time I realized it. pretty minor really. I went tot he judge and he was like "sounds like you were in the wrong place at the wrong time." I think I paid court costs or something like that. My recollection is that the default is to give it to the car following, and it's up to them to prove it was the other guys fault.

    Like with most citations if you go to court you will most likely get out of your ticket. If the officer doesn't show then you are in the clear. Unless he wants to stick it to you then he'll be there but don't expect it.

    I rear-ended someone last December because they stopped in the middle of busy intersection for some damn reason. I slammed on my brakes but the ground was re-freezing and I slid into them. Probably hit them going 5-10 mph. Still caused damage. I could have settled early with the city attorney for the minimum fine plus court costs but I wanted to try my luck. It was probably a waste of time because I lost anyway. Total fine came to $147 for me.

    Hard to tell, like the cop said probably depends on the judge you get. Usually the last person in a bumper accident is the one at fault. Had a co-worker who hit someone that stopped short on I235 once and luckily the person behind him hit him as well. Turns out the last car in the 4 car accident was the Des Moines Police paddy wagon! Talk about your luck, cop already on the scene and he's the one that will be at fault in the accident!

    Probably have to at least pay court costs, usually around $50.

    This is no longer true and has not been for some time. The first appearance is a preliminary if you plan to contest. The issuing officer is not there, but f you plan to contest the officer is notified of the new court date and does show. They have scheduled time for court now a days.

    Didn't we just go over this recently. This isn't true anymore and in most places the officer that issued it doesn't even have to be the one there they just send another officer that will read the report. None the less the tactic to show up just to fight it and hope he doesn't show so it get's thrown out doesn't work anywhere anymore.

    My brother is a deputy and rarely goes to court. He just types up a statement and the judge uses the statement in place of the officer's testimony.

    Also, he many times will write people for less than he is capable of. When the person challenges it and take it to court, many times the judge actually increases the fine for wasting the courts time. This isn't meant to discourage people who have a legit case to challenging, rather to punish people who are just trying to get out of it. Point being if you're innocent that is one thing, but if you're guilty you should own up to it.

    That's what I figured, I know a couple of officers in the CR area and just from what they have told me as you have stated the rules have been changed in numerous ways to prevent people from wasting time/money and just trying to get out of a ticket.
