The NCAA by-laws do say that a 'repeat offender' can be subject to the death penalty, however that is the absolute worst case scenario. There are several repeat offenders and as you've seen the NCAA has yet to hand down the death penalty. Remember, Ohio State football was a repeat offender for their football program with their latest scandal, but they certainly did not get the death penalty.
